Dear friends

One of my friends is in unique situation. He is accountant by profession well educated and few years back he entered canada on unskilled permit because he had no job here in his country. He worked for less than an year and returned back. He never reentered Canada because of the fact he didn't liked it to work on the same scenario. So he never used up his stamped visa for the second entire term. Now he is married to canadian citizen and filing the PR application but is providing all the educational documents. Now the problem is he showed that he is undereducated wherein he was not but did only coz of the scenario he had no job here.

What are the implications that he has to bear. The marriage is genuine with all the proofs and everything....

Please help in this regard and how he should proceed on this.

Thanks in advance.

I don't think it will be considered relevant. He should just answer the questions on the PR application truthfully, and provide proof of his education.
If the visa officer questions him at the interview, he can give them the explanation you provided here. I wouldn't put this explanation in the PR application though - maybe it won't even be noticed.

Did he already send the application? If yes, my advise would be to write down the situation, giving all the details and then fax it. otherwise even he/she has a genuine marriage, he would be misinforming and there can be consequences. I wouldnt take that risk myself.

Because his misrepresentation was in the previous application, not this current PR application, I don't think it will matter. For a misrepresentation to matter, it has to be the kind that would make a difference in the decision made. He said he had less education than he actually did, not more. Plus it has no bearing on whether his marriage is genuine. Maybe it impacts his credibility.
Be truthful on the current application, yes.

Let's see what other forum members think.

@canadianwoman;

do you have any estimate on when the appeal will be and where it will take place? or is it still just processing?

It depends on what the application is like. From what you've said, it seems OK. But there might be other problems you haven't mentioned.
Since he didn't use his second entry, it doesn't sound like he is desperate to enter Canada, which is good.

Is this a spousal PR application? If so, I'm pretty it is not required in the documents that the sponsored person spouse provide any educational documents just a history?
