URGENT! Help Needed- WP Expires soon..!

Hi All,
I need your advise please!

I have applied e-APR/ JUNE 16 AOR- which might take more 4-5 months to finalize.
Currently, I am on open work permit which expires 31st July 16. My OPWP was based on my spouse's student permit which will expire the same date.

My wife has completed her study and graduated recently. So I was in impression that we both can renew workpermit (PGWD for her and open workpermit for me) without any trouble for maximum of 3 years. We had submitted application for PGWD and my Open WP on June 21.

Today's I got a request letter to submit "my wife's employment letter with 3 pay stubs" that she doesn't have!
She had never worked and searched work in Canada as she was studying and I was working only.
She is graduated now, is searching for job.

So, I have 2 options:

Option 1 :Submitting LOE that she is searching job- if I do so, they might reject my workpermit

Option 2 :I have valid job offer(LMIA) on the current job, applying my workpermit from LMIA.

As I have only one week left for my current work permit, please advise what to do?

Right, you're not eligible for OWP unless you wife have job in NOC 0,A or B.
I would suggest you to apply for BOWP before your wp expire. You should be eligible for it if you're main applicant in your pr application

This is common knowledge. Your spouse needs to have a full time job that is NOC A, B or 0 - and must have started this job and be able to provide at least one pay stub in order for you to qualify to renew your OWP. In the Foreign Student section of the forum - we see refusals all of the time from people who don't understand this rule and apply before they qualify.

If your spouse doesn't get a job in time, you will have to apply to convert your status to visitor and stop working once your work permit expires (make sure you apply for the visitor visa before your work permit expires).

In your case since your wife recently graduated, she is eligible for a PGWP if she meets the PGWP criteria. If the CIC asked for her pay stubs, you should inform them that she recently graduated and has not worked (assuming that she was not employed as a student during her studies). You should withdraw your BOWP since you do not qualify for it as yet. Similarly, in your case since you applied for a WP based on your student spouse, you are ineligible for a BOWP. Once your wife gets a PGWP, then you can apply for a new OWP.

Yesterday, I went to the US boarder and did flagpole and got my permit renewed based on my valid LMIA and the another good news is my wife PGWD also approved for 3 years today and I have submitted a LOE to withdraw my OWP as you said.
