Hi!

My family and I moved to Canada in 2012 from Bahamas under the temporary foreign worker program (me) as a Senior Barber/Instructor.I was approved for my first work permit and that expired last year.My employer and lawyer applied and filed for a new LMO as required, to renew my work permit before my old one expired. After almost an entire year of calling LMO and not getting any answers as to why my application is taking so long I finally received an answer

My employer finally received the letter in the mail from LMO which stated that my request for a positive LMO was rejected unfortunately.I am a bit sad about it :( because my employer under the guidance of my lawyer did everything that they were suppose to do which is why we don't understand the reason for the rejection. The letter stated that LMO did not think my employer can fully fulfill the terms of the employment contract.

My first application for a positive LMO was approved under the same conditions by this very same (Label Market Opinion)and everything was fine which is why I don't understand what the problem is this time if nothing changed. My lawyer is now working to appeal the rejection and is willing to prove that my employer can.I was so excited waiting to receive an answer from LMO. I was also planning to look into applying for permanent residency for my family and I since I met the requirements and finally found a place to call home.I really would like to stay in Canada and continue working as I love it here.

Any Advice.

What's your current status in Canada?

What happened when your work permit expired last year? Did you change your status to visitor? Are you still here on a valid visitor visa?

Visitor and Yes we did but now we are working to appeal it.Would it be better to appeal it or apply under PNP or a different program. My lawyer wants to appeal it but I just wanted advice from others as well as to what would be best in this case to do

Appeal will take a lot of time and to be honest it won't help you much but if you want to do it then go ahead.

My opinion is that if you have a year of experience in Canada as a Barber NOC 6341 you should apply for CEC (Canadian Experience Class) it's the easiest way. If you send you application for permanent residence it will take approx. 7-8 months so even if your appeal won't succeed you will still have something.

If you want to apply through PNP it depends in which province you are.

Ok thanks!

But is it possible to just go ahead and submit an application for permanent residency since I already have the one year work permit requirement as well as the other requirements to apply. My last work permit was under the CEC so since I already have that would it be best to go straight for permanent residency instead of applying for another work permit when already did the one year requirement?

I don't really understand what you are trying to say. You couldn't have work permit under CEC since it's immigration program:

"If you are a temporary foreign worker or a foreign student, and have skilled work experience in Canada, you may be in a good position to move from temporary to permanent residence under the (CEC)."

CEC (Canadian Experience Class) is the best way to get your permanent residence.

Here you can read more about it: http://www.cic.gc.ca/english/immigrate/cec/apply-who.asp
