My 2nd-wife Sponsorship Application is under process and near completion:
If a person 1st-married and then divorced his wife. He will adopt following procedure according to Muslim Family Law Ordinance(MFLO), 1961, Pakistan:
1- Divorce Certificate on Stamp Paper / Court degree
AND will also get
2- Formal Divorce Certificate from Chairman, Union Council
THe High Court and Supreme Court in Pakistan has alraedy been given verdict against section 7 of MFLO, 1961 that Formal Divorce Certificate from Chairman, Union Council is not necessary. But CHC, Islamabad is still using old laws and requires # 2 document.
Another question is that, if a person married in Azad Kashmir(Independent Territory), Pakistan:
There is neither Formal Divorce Certificate used in Courts Nor used in Union Council/Local Bodies due to Islamic Laws implemented, only "Divorce Certificate on Stamp Paper" is sufficient.
What will he provide in embassy instead of Divorce Certificate from Union Council?
Will he get a letter from Registrar of Marriage [ Tehsil/Zila Mufti(Religious scholars in coutrs) ] that Divorced has been occurred alongwith Divorce Certificate on Stamp Paper / Court degree.
Please let me know for further details. Waiting for reply.
