I'd apply to restore his status asap, explaining the unfortunate situation. You have a good excuse, they will approve him. Just play their game and give them all the proof they want that he will leave if not approved. Then I'd withdraw the inland app and apply outland. Someone from September just got processed through Vienna in 3.5 months!
