****URGENT**** CBSA Enforcement Letter recvd

Hey guys, my husband got a letter today asking him to come in for an appointment with the CBSA Enforcement office, we don't really know what to expect, can anyone offer any advise, Thank you

Background info, my husband is a failed refugee claimant, filed appeal it was denied. That's the last info we received from them, didn't receive any follow up about the failed appeal, his lawyer was actually the one to let us know the results. Our spousal app was recvd Dec 10, we got AOR in January haven't heard anything since. Now we get this letter asking him to come in for an interview n to bring documents, please I'm getting stressed again, what does this mean??!?!?!

I think the only answer is for him to go and see what they want.

It's my understanding they usually do not remove people who already have AIP. However I don't know if this is a hard / fast rule or just a general practice that has exceptions.

This might be an interview for a removal order.
My husband was a failed refugee and he had a letter hand delivered to our house by cbsa telling him to come in for an appt at a specific time. And it turned out to be when he was given his removal order and after that he had 30 days to leave.

But if u already applied for sponsorship. Take those documents as proof with u to the appt. And hopefully they wont remove him.

When we out our appt. We had already sent out the sponsorship for outland. But because step 1 hadnt been approved they wouldnt allow my husband to stay.

Thank you everyone for your advise, with the new legislation in place I just dont know what to think. From what I've been able to find out the interview is to determine whether they will remove him if they do, there may be an appeal we can submit. All of this still doesn't give me much reassurance because its in the hands of an human being, We're praying the interviewer will find favor and allow our sponsorship application to complete it's process. It's only 2 months before our stage 1 comes through.

Hi,I was in your shoes last November,I had applied for PRRA more than six years prior which was rejected in July 2012,however,the officer gave me a chance to apply for spouse sponsorship ,(God bless him)my removal was administratively stayed pending the outcome of the application and i'll always be grateful!My opinion is it depends with the officer you get..Crossing my fingers they will allow your husband to stay as well until the decision is made especially because you've already sent your app already!....Sending positive vibes your way

Hi, your husband is not elegible for prra, and unfortunately a letter from cbsa is for an interview for removal, the problem is that they have just one job remove people,, the only way to be safe for your husband to stay is to receive the AIP (completing the first stage), i had the same problem and they gave me a date to depart but in those 30 days i received my AIP so i was able to stay (the minimum time to get AIP is 6 months since the date they received the file, so before this 6 months its unlikely to stay),, like other people say here it all depends on the officer, they say that they dont but they DO have the power to let you finish your application, if you get a good officer (rare) he (she) will let you finish the application, if you get almost anyone its almost sure that your husband wil be asked to leave canada, if you have a lawyer tell him (her) to go with you to the interview, most of the time they can stop the deporting process right there because of technical detais.. good luck..

Just this one page of posts from you all have been an INSANELY HELPFUL!!! I'm a failed refugee claimant. I have ONE important question, but first here's my background:

A good 5-6 months after being denied, my husband and I did the civil marriage to get it out of the way because we were planning our wedding for 2013. I was lucky enough to get an amazing lady officer who said all I have to do is check in by phone monthly and when she saw me and my sis in law, she had no doubt I'd be fine and able to get our sponsorship app handed in on time and all. Unfortunately, at the beginning of August I received that CBSA hatemail and it turned out to be a removal order. I had the UNFORTUNATE luck to receive an all too young and new officer, who had no idea what he was doing nor did anyone else who was present that morning (either that or the *censored word*s couldn't face my American raised angry self at 9am...) because I was beyond fuming when this child of an officer said he cannot grant me a stay (extension past removal date) to finish collecting necessary docs from the U.S and Canada to apply. Despite me telling him that he is wrong and that I have legal advice and knowledge to back that, he just stood there like a deer in headlights and kept apologizing to me, because that was supposed to make me feel better somehow (and my 4 Canadian family members behind me).
So, it truly IS up to the officer you get. Sad, horribly sad but true.

My question is, I noticed some refused refugees did NOT have to go through the interview process aka it was waived- is this normal if they see that you have a genuine relationship and provide solid evidence of it? (We are a normal, young couple, met through my best friend aka my husband's cousin) My husband was even present at my refugee hearing back in August 2011. I was denied late in Dec.2011. He KNEW I may fail, but love is love! There is no limit to it <3 (btw, we met at the end of May 2011)
I am currently stuck overseas in Europe and getting to Vienna for an interview is not only expensive but, well... absolutely terrifying, because I am tired of these horrific immigration officials. I'm pretty sure they are tired of my American sarcasm as well =/ It's not my fault they hire idiots.

Everyone on here is absolutely amazing for helping one another out. Hopefully I'll be able to pitch in once we send in our spousal sponsorship app at the end of this month.

My husband was a failed refugee, and we applied as common-law, we are also both Young and met through friends, and have been together 3 years.
He was approved for his PR and his interview was waived, Because of the extensive amounts of quality evidence we provided.

I know a few people who have sponsored there failed refugee spouses and had the interview waived.
It all depends on how much quality evidence you can provide.


the same thing happened to us, alot of people told us we would be able to stay longer to wait for at least step 1 of the outland to be approved. but my spouse ended up getting a removal order anyways and the officers were nice but told us that they cannot let him stay cuz they were worried they would get fired. dumb cuz its allowed but w.e

anyways with good evidence you can avoid the interview even with a failed refugee applicant

I dont want to scare you but i have heard of people getting detained when they show up for the cbsaappoitment. My hudband was a failed refugee and during the process of our inland application they deported him. We have a daughter as well and they didnt care. And while he was detained i met alot pf people and different stories nd some of them were called for a cbsa appointment and they would detain them and mostly all were deported.

This made my day! Thank's a bunch for that info!!! My husband is less tense now too lol, upon hearing this. We have a lot of evidence, from skype logs, cell phone logs from when i was still in Canada, everyday emails since being given the boot lol. Plus all my closest friends and fam have visited from NYC and most know him or of him. A good 20 or so letters are also in our court. I'll keep everyone posted so people in our situations know what's going on within the next few months (As soon as someone opens a June 2013 Applicants thread lol)

I'm so sorry to hear that. Did he perhaps not report to CIC at some point? They don't detain people unless they believe them to be a flight risk (aka they will go into hiding).
Are you sponsoring him at this moment?

No he never ran nor got any papers after the failed refugee claim. And when we started the inland the lawyer said he didnt have to leave cause of our app and that we have a daughter as well. Well that was a bunch of bull. So after they deported him i re did his application by msrl and so far so good just hoping this strike wont effect anything. I hope that nothing bad happens to you or anyone that is truly in love and in a genuine relationship. I wouldnt want anyone to have to go through what we have gone through this past year. I just hope he comes back soon
