I am a May 2010 applicant. I got a rejection letter in Mar 2013 stating I did not comply with the medical request sent to me on Nov 09, 2012. However I never received one. I sent a case specific enquiry, fax and a hard copy letter thru Fedex stating that I never received the medical and shocked with the whole thing. However after a wait of almost 45 days, I got a medical request yesterday. I want to share this good news so that it brings hope to people who might be in a similar state as I am.

They have stated that a medical request was sent on Nov 9th and they did not received a response within the specified time and the file was refused. Upon further review, they are unable to ascertain that the email was received by me and therefore have decided o reopen my application and give me one final opportunity to comply with the request. I have been requested to proceed with the medical and submit the requested docs within 45 days.

Here is what has been requested:
Application form IMM08 Generic with updated info
RPRF
Proof of Funds
Passport size photos
Medical Exams for me, spouse and children
Foreign travel form
PCC for me and spouse
Original and expired passports for me, spouse and children.

My problem is I can provide everything except for my passports as I have a scheduled travel to the US coming up in mid of June. I know it is illegal to send the passports via any medium from a foreign country so I don't want to send my passport from the US. My child needs to undergo a surgery from a previous injury end of July. So I am planning to talk to my employer to post pone my travel to last week of July stating my daughter's surgery. They might agree since they know about my daughters condition. However I need to land in the US in the first week of August (which is already kind of late to renew my H1B visa in the US which is expiring end of Sep 2013).

1) Would it help if I attach a letter from my employer about the need for me to travel to the US in June with a request to expedite my passports?
2) If I send all required docs by 1st June, what are the chances that I will receive the visa or decision by Mid of July? If I don't get my passports in 45 days then I will lose my H1B as well.

I look upon the experience of people in this forum to help me take the right decision. I would appreciate any help in this regard/

Listen my friend, if you go through the entire email received for the medicals and other documents request, you will find a line which which states that if you can ot send your passport along with the medicals, you have to give them a written explaination to justify that.

Just send a type letter address to the visa officer along with other documents stating your travel plan. This will be enough. They just want to keep your passport so that when they are ready to issue you a visa, they are no further delay.

Thanks for your reply. I read the entire medical hard copy letter and it does not state anything about not submitting the passports with the medicals. Anyway, I don't have any choice left as I need to travel to the USA probably in the next 3 weeks for sure and I need to file for my H1B extension. So I will provide them a written explanation about it. Our company's HR would also provide a letter stating the urgency of my travel to the US and my inability to submit the passports right now.

Do I have an option to go directly to the High Commission for stamping at a later stage when they are ready for processing? Has anyone done this in the past?
