URGENT - Application to extend / restore my stay after WHV expires in 2 days!

Thank you in advance to take the time to read this! On a Sunday!

My working holiday visa expires in 2 days, February 28th. I'm currently working as a room attendant for a hotel in Alberta. My employer is in the process for a LMIA and I've got told that they will at least submit it in time so I can apply for an extension / restoration or whatever.

Turned out they haven't submit their application for the LMIA yet.
They sent me a "letter to support me" in which they say:

Re: work permit application for xxx (me)

This letter is to confirm that xxx (employer) is currently working towards obtaining an LMIA for

  • Room Attendants
  • Noc 2021 code: 65310
  • Work location: xxx

    Should you have any questions, please contact me directly. I would be happy to answer any questions you may have.

I received this supporting letter and a valid job offer on Friday in the evening and could not talk to the HR department personally before they left for the weekend. I'm pretty sure they are only one step away to submit their application but I have only 2 days left.

What would you do in my position?

You stop working when your work permit expires. Change status to visitor if you want to stay in Canada. You need a LMIA to apply for a work permit. Or are you eligible for another IEC permit? Also look at Alberta’s PNP program (AOS) and see if you are eligible for PR with the job offer. This doesn’t let you work since your permit expires in two days.

Yes, I would have to apply for a visitor record since I'm not eligible for another IEC permit because of my age nor I'm eligible to apply for the AOS because I don't have enough work experience in this position.

Let's say I stay here as a visitor, stop working and wait until the LMIA got approved. Do I have to leave the country to apply for the LMIA and do I have to wait until it gets approved abroad?

COVID policy for applying for LMIA inland ends on February 28th, and has yet to be extended. You may need to apply from LMIA outland if policy doesn’t change. Assume employer meets requirements for LMIA and has already posted the job on Job Bank and other sites.

So thanks to COVID there is a bit of a chance! I didn't know that! Thank you!
And yes, my employer posted the job already. There are literally one step away to submit their application.

Sorry worded that wrong. You need to apply for the closed work permit before February 28, not the LMIA.

My work permit is valid until February 28th, can I already apply for a visitor record today or tomorrow though?
Would it make sense? Or do I have to wait to February 28th? Then I would have to apply for a visitor record and the public policy on the same day. Do you think it would work?

I'm sorry, I'm so stressed out and overextended right now...

Apply for change in status by the 28th, not after. The public policy does not pertain to you because you don’t have a LMIA to apply for a closed work permit.
