Urgent Advice required - Restoration of Status

My husband and I applied together on October 3, 2024, for a PGWP (me) and an SOWP (him). On January 14, my PGWP was approved, but his OWP was refused because we didn’t provide proof of my employment in a NOC 1 job, which was required. This was our oversight, as we both have NOC 1 jobs but didn’t include a letter of employment. He has stopped working immediately and is now deciding whether to return to our home country to reapply or stay in Canada and apply for restoration. What are the pros and cons of each option, and which would take longer?

What were the specific reasons for refusal IRCC noted in the refusal letter of the SOWP?

This is what the letter says -
You have not provided sufficient evidence to prove that your spouse is employed in an occupation that falls within the National Occupation Classification Skill level in TEER category 0, 1, 2, 3, 4, or 5 occupation. You may be eligible to re-apply for a work permit if you are able to provide proof that your spouse is a skilled worker in Canada, which may include a letter from your spouse’s employer, stating his/her job title, duties, and salary.

Like I said, this was our oversight. We both have had NOC 1 level jobs before the initial application on Oct 3, so we should have provided the relevant documentation.

I cannot speak in regards to your original question but this might be very useful for other eyes with more knowledge to look at and advise. Positive news is it clearly indicates that you are allowed to apply again so at least you still have that door open. Best of luck!

The SOWP is really a new application so he could only restore his status to visitor. Do what is best for your family and what is financially feasible. Tough to say how long SOWP is going to take to get processed but should be approved given the situation your presented and if you have 3 pay stubs.
