Hi,
This is with regards to my wife's immigration, i had sponsored her after our marriage under family class in 2009, she got her immigration and she came here and stayed with me for 6 months, but due to my father's illness back home in India, we decided that she will go to India and i will travel between India and Canada to maintain my PR status and my work. My father was diagnosed with cancer and due to this she couldn't return to Canada. And her PR expired in 2014. Now we wanted to settle down here, I'm now a Canadian citizen, so i sponsored them for new immigration along with our children(last month) who were born in India before me becoming Canadian citizen.

The immigration office here sent me a letter stating that he will retain my immigration application and asked to apply for travel document for my wife since she already had a PR and get back to him with the response from the Canadian immigration office in India.

My question :
1..Since she stayed for only 6 months, if they grant travel document on Humanitarian condition will she be able to renew her PR card immediately after coming to Canada.
IF NOT
2.since my children born in India before i became Canadian citizen, And never were PR,I have applied for their immigration along with my wife. should i apply for there separate Canadian visit visa along with application of travel document of my wife. So that they can travel with her if she gets the travel document,
or can she visit Canada and apply for PR and go back immediately to stay with our kids until the PR process is complete.

I will appreciate your help, looking forward for your reply. Thanking you in advance.

Best regards

Job Offer........
Pre-Assessed..
Her PR status did not expire in 2014; her PR Card expired in 2014. Technically, she is still a PR of Canada. However...

Since she has not met the Residency Obligation of spending at least 730 days within each rolling 5 year period, in Canada, she will likely be reported for non-compliance when she returns to Canada. She will still be allowed to enter Canada, but would be scheduled for a hearing where she would likely lose her status.

Or...

She re-enters without being reported. If this happens, she would need to remain in Canada for 730 consecutive days and then apply for a new PR Card.

She may have better luck flying to the U.S. (depending on the Trump-igration B.S.) and then re-entering Canada at a land border in a private vehicle (no PRTD needed).

Good luck!
