Updating martial status for PR

Hi there,

During my application & approval I submitted as single while I had a boyfriend. We lived together for over a year but never officially signed common law declaration.

After I was approved PR we both signed common law declaration- do I need to update CIC?

Any help would been great!

Have you already landed and become a PR? Or are you still waiting to complete landing activities?

If you haven't landed, you must notify IRCC immediately that you are now common law and complete the paperwork to add him to your application. You must also return your PR visa and wait for a new one to be issued that lists you as common law (rather than single). Whatever you do, do not land using the PR visa you have now. If you do that, you will never be able to sponsor your partner for PR.

I hope you haven't landed as PR yet. If you did, and you didn't add your common-law partner to you application, you committed mis-representation.

Also you can never sponsor your common-law partner, since you didn't included him in your application.

If you haven't landed yet, you should inform IRCC. And added him to your application. Wait for the rest of the process that includes his medical exam, police clearance and detail personal information. They will issue new COPR for both of you.

But we weren’t legally recognised as common law at the time I applied for PR so technically we weren’t declared as common law until we signed the declaration right?

You don't have to be "legally recognised" as common law. You lived together as a couple for 12+ months, so therefore you ARE common law in the eyes of CIC. Because you did not file as common law your boyfriend is now excluded from being sponsored by you forever. If you wish for him to move to Canada to be with you he will have to qualify on his own. You cannot sponsor him ever. You also committed misrepresentation by lying on your application where you stated you were single when in fact you were in a common law relationship.

If you already landed as single when in fact you were in a common law relationship the damage has already been done so being married now would make no difference.

It will make no difference. You can never sponsor him. He will have to qualify on his own through an economic immigration stream like Express Entry.

Should I renounce my current Pr & apply again with common law? What are the chances that would work?

That is another option if your common law spouse cannot apply by himself.
This would be an application for both you and him as common law. I don't know how you obtain your PR, so I don't know if that will affect the "points" or "score" for that.
