Have you check up on your area or community support for drug use and how they can help. you can ask your doctor if they can advise you on where and how to seek hhelp for your wife or partner. Look into the local papers or community info and you might get a help start from there.

am sorry and sad for this but you have to act soon and quick

You would not necessarily have to leave Canada if you are in an abusive relationship.

Whilst this website is aimed at women, the same principals apply - look at the "abuse by sponsor whilst not yet a PR" section - it says you may be able to make an Humanitarian application.

Q. If I leave my sponsor how will it affect my immigration status if I am NOT yet a permanent resident?

A. This section applies to women who have inland spousal sponsorship applications in progress. Women in Canada with or without temporary status in Canada can apply from within Canada under the “Spouse or Common law Partner in Canada class.” If you have applied inland for Permanent Residence and are experiencing abuse in your relationship with your spouse or partner sponsor, the following information is important.

If your application for permanent resident status is in progress or you have temporary status, it is best to get legal advice before making any decisions about leaving your partner as you may be at risk of being removed from Canada.

If you have already left your sponsor or need to leave for safety reasons there are remedies available. Citizenship and Immigration Canada does not expect an abused woman to live in danger.

If you decide to leave your partner, you can pursue an application to remain in Canada on humanitarian and compassionate grounds (“H&C Application”). If you have a removal order made against you, in most cases you can apply for a Pre-Removal Risk Assessment (PRRA) and make an H&C application.4

In any case, you should talk to your own lawyer. It is essential that you obtain independent legal advice because your partner’s lawyer must act in the best interest of your partner and you cannot be guaranteed adequate legal representation if you depend on your partner’s lawyer.

Q. What is an H&C application?

A. This is the short title for an "Immigration Application Made in Canada on Humanitarian and Compassionate Grounds."

An H&C application is a request to exempt the applicant from the normal requirement of having to make an application for permanent residence from outside of Canada. Abused women can apply to stay in Canada for humanitarian and compassionate grounds. Successful H&C applicants receive Permanent Residence.

Canadian Immigration policies specifically address domestic violence and require immigration officers to be sensitive to women who experience domestic abuse.

To get Permanent Residence based on H&C grounds, applicants must show that there are humanitarian and compassionate considerations relating to their case. Officers must consider the best interests of any children that you have when deciding an H&C application.5 Officers are also required to take into account situations where a woman leaves her spouse or partner because of abuse in H & C applications.6

Your H&C application has to provide details about the abuse, your children, how established you are in Canada and the hardship you would face if you had to return to your country of origin.

If you are thinking about making an H&C application, you should speak with a lawyer. A lawyer can make sure you do not leave out any important information.

An H&C application does not give you any right to stay in Canada while you are waiting for an answer. Once you have made this type of application Immigration may still decide to remove you from Canada -- they do not have to wait for a decision on this application. However, you can apply to Federal Court to stay your removal while you are waiting for a decision on the H&C application.

If you are facing an admissibility hearing, it is essential that you make your H&C application before the hearing as the member at the hearing does not have the power to delay the hearing, nor do they have the power to decide an H&C application.

If immigration approves your application "in principle," you are eligible to apply for a work permit.

thank you for your help, but i have left Canada and i am back in UK. She needs to sort herself out if she wants us to be together. My immigration is still in process and i don't know what to do about it. I am probably going to leave it for now too much stress i cant take it any more.

she is telling me she loves and would do anything to keep us together. but i have left Canada and i am back in UK. She needs to sort herself out first if she wants us to be together. My immigration is still in process and i don't know what to do about it. I am probably going to leave it for now too much stress i cant take it any more.

I am very very sorry about what you have to go through. You obviously love your wife very very much. I can tell just by reading your posts. Im also very sorry that you had to leae canada . Whatever the outcome, i do wish you and her all the best whatever the outcome..i hope she gets the help she needs so that you can be together..

I work in a drug and alcohol rehabilitation centre. So I can tell you that you have done the right thing. Remaining with someone that is on a self destructive path is not healthy for either of you and often you end up enabling them with their habits. (THIS DOES NOT MEAN IT IS YOUR FAULT!!) She needs to hit rock bottom before anything can proceed with your relationship and you did the best thing to keep your sanity and to let her know you will not tolerate this kind of behaviour in your life. I know you love her and it was not easy.

Not only do I work here but I also am a child and sister of alcoholics and drug abusers. I went through a stage in my life where I abused also but was able to climb out of that pit and am now healthy and happy.

If you would like any information about where I work send me a private message and I will certainly give you the information to pass along to her. I pray that she will soon see that her ways are destructive and she is losing the most important things in her life. Drug addiction has no easy solution...it takes a lot of hard work to stop and to keep stopping and to make new friends and get a new direction in life. But it IS possible...I am living proof!! There is hope out there for her if she is willing to take the steps to a new life. And then you can both come together again.

I am sorry about your experience but you have done the best thing and I wish you both the very best in the future. God bless!

I really miss my wife, she is been doing great ever since i left Toronto she is focusing on her work and staying away from people that cause her stress and stuff. She is asking me to come and wants to go counselling with me and get rid of her habit. I am glad she has learned and wants to move on, therefore i am thinking of going back.

If i do plan to go back i have to go as soon as possible because my TRV is expiring on 4th sept 2010. I am thinking of going back on 30th august. My only worry is the IO officer questioning me about my visit for only few days as my visa is expiring. I think i am going to tell him the truth that i am married and my inland application is in process, I will assure them i will return back to my country if my application is denied and i have enough funds to support myself until than.

I have already travelled before, i left Canada for two month 2 go to England and came back without any problems the IO didnt ask me any question about my application.

Any thoughts.?
