PS i cant pay of the credit card yet as my husband is the only one working.. But eventually we will pay of the credit card in one go!

I think that your criminal record check is going to come back showing that there is an outstanding warrant for fraud if the bank filed it. Good luck

Thank u so much... but Will that affect my PR?? if i explain my reason?
Quite probably, as CIC will want to know what you are going to do about the outstanding warrant, if there is one. It is unlikely that they will complete the processing of the application, until they receive an explanation.

I suggest you contact credit card company and set a payment schedule that you can afford on one income. The company would likely prefer a very slow payment than wait and wonder if lump sum payment will be made at some point in the future. Better to work with them than to be chased by debt collectors and risk a criminal charge for non-payment. Plus if cic wants an explanation, you will have proof that you are attempting to settle the debt on a minimum payment schedule.

I will give you my advise, I Live in Dubai and I work for a bank here in Dubai.

If its more then 15,000DHS then the bank has filed a case against you, and that means its with the courts right now, the bank has no control over, because its a criminal case against you, so you will have to pay the full amount back to the bank.

What you should pray for is, if the courts will drop the case against you if you pay.

Because in allot of case I have seen the courts wants you to pay and go to jail for 1-3 months (90%) of the time.

Even if you send the payment to the bank you will still have a bad police certification.

What I think you should do is hire a lawyer in Dubai, to see if you can pay the credit card payment without doing Jail time.

here in Dubai we don't have debt collectors, we have police come to your door and arrest you if you haven't paid more then 6 months,
Thats why allot of people if they see they cant pay there loans here after 2 months they just run away.

lol, Bilal you are right.... I have lived there and my family is still there and I agree that I have seen peopel running away without paying debts..... even I have seen people financing 100,000 DHS roughly $35-40000 or even expensive cars and then just leaving them at the airport without even letting bank or anyone know. What a world eh? But what people don't recognize is that we will probably need to have some kind of link with Dubai in future and then they realize that it's kinda late now. And the law there is ridiculous in some cases. i must admit it's a nice country from some aspects but i hate that country and it's stupid rules and the way they treat immigrants there. It's demoralizing to see their behaviour and no wonder you will see lot's of people doing this no payment thing and run away.

While in this case this lady and her husband are just merely a victim of fate and can't pay the debt at this point which can happen to anyone but I just hope things will work out for you. And you might wanna do what Bilal suggested because they won't even give you police clearence certificate. Here in Canada or some other countries they will at least provide you the certificate with a note on ti exoplaining that you have a criminal record or whatever. But over there they don't even give you and yes you should pray that it's not in court yet because after a certian limit they also blacklist the names in their immigration system which means you definitely have a criminal record now and unless you do according to thier law you won't be forgiven and in some cases even if you go according to law they still will keep your name in blacklist.

It's a screwed up system. I am not trying to scare you but telling you the things that I have seen while I was there. Anyways for Canadian immigration you do need a Police clearence no matter what. So, you better get on it.

Good Luck! I wish you success.

This would be a civil issue in Canada; hopefully, CIC will judge you on the basis of Canadian law and not the law of countries that apparently still have debtors' prisons.

Hi there. I just want to know what happen to your PR application in Canada. Did the case in Dubai for non payment of credit card affect your PR application. Hoping for your reply as I am in the same situation right now.

Thank you.

Hi,
FYI: I still have an unpaid loan and credit card from Dubai from about 3 years ago.. I applied for the Certificate of Good conduct a few months ago and received it a few weeks ago. So no issues getting it still with unpaid debt.
Got my PR soon after that..

Just for go for it and ask for a police clearance. Don't overthink, sometimes tha bank just write it off instead of hiring a lawyer and file a suit, it will cause them a lot maybe more than you owed from them. And the bank wants a good financial report.

Good luck.

Hi aussie. Thank u for the update. Please advise how you get your police clearance? Did you do it online or you asked someone from Dubai to get it for you?
