Hello all,

I have employment contract but they are not notarized. I try to secure notarized copy from my employer but the copies they have are not notarized too. We plan to send an explanation letter to explain the scenario. Do you have any advice.

Please help.....

As per Manila Visa Office Instructions, they require:

WORK EXPERIENCE (FOR THE APPLICANT ONLY)
For you and your spouse or common-law partner:
copies of employment contracts from your present and past employers,
accompanied by an English or French translation

Question: Isn't it that photocopies of documents need to be certified by an authorized individual as per CIO instructions?

page 21 of CIO Instructions
Who can certify copies? People authorized to certify copies include the following:
In Canada:
 a commissioner of oaths
 a notary public
 a justice of the peace
Outside Canada:
 a judge
 a magistrate
 a notary public
 an officer of a court of justice
 a commissioner authorized to administer oaths in the country in which the person is living

We tried having them notarized but since the dates are years away, they turned us down. The only option left for us is to have our copied certified by the employers although they are not included in the list. I will just attach an explanation letter to explain the scenario. Any advise?

I am also gathering my documents and I am also from the Philippines.

Based on my understanding, the copy of the employment contract shall be issued to us as certified true copy of the original, meaning a photocopy but certified copy of the original. The certifying agent is probably the HR Manager or President. Now, the notary will only declare the authenticity of the signature of the certifying agent (HR Manager or President) and not the original signatories. That is my understanding. I hope the seniors will enlighten us on that.

Also, how do you explain if your employer cannot provide you an employment contract? I joined general professional partnership and we didn't have an employment contract. What is the best way to explain this?

I am trying to draft a letter explaining that the employment was made without having any written employment agreement between both parties. I just don't know the right word to use but I want to imply that the employment started and ended without such document to bind them. The employment was based on trust and confidence. If I may say in my native tongue, "Tiwalaan na lang"
