Hey all, I have an urgent question to ask and appreciate anyone can help.

We are moving out the current apt and having some disputes with the landlord re the payment on the some damage we made, he email me earlier saying that the legal action will be taken against me and report to credit bureau and to the immigration Canada, just wondering if this will impact my PR application? Or will we be questioned when we do the landing? The email mentioned I will get trouble if I attempt to return this country.

Advice from you will be appreciated. Thanks in advance.

No, your landlord is just being an idiot. Something like property damage isn't going to affect your admissibility unless you are convicted by a court. As for the credit bureau, what drugs is he on?

He is stupid, he can't do any thing. He will cut from security whatever required. You don't need to do any thing ...

Thanks LPS, you said unless I am convicted in the court, I assume only crime will be convicted, the dispute is civil natter, correct me if I am wrong. Thanks again.

Well, just read contract you signed...alberta has different contract rules than Ontario..usually this kind of dispute goes here in alberta

But it's not counted as conviction..so don't worry and don't get pressurized by these ugly tactics. Also if u think damage is not there claim your security..because in end you know the situation better.

Are you in Ontario because as far as I know, they are not allowed to collect security, only first and last months rent. In AB, they are allowed to keep a damage deposit in the amount of 1 months rent and it is extremely common that the landlord tries to keep it by making up some damages, blaming you for what was already there etc.

You should go to the tenants board if you have a dispute and see if they can do something. If it ends up in court, it's still a civil case, not criminal. If you are ordered to pay, you'll have to pay but the credit bureau has nothing to do with this and neither does immigration. I think your landlord has been smoking something or they are trying to scare you.

I'm not a lawyer but that sounds about right. The point is that he's threatened to report the damage directly to CIC. Unless it's an immigration matter then they aren't going to care.

I am in Ontario. There us no security deposit allowed in ON.

Yeah, it sounds very ridiculous and threatening, the thing is we are leaving Canada soon while awaiting PR, not sure how he is going to chase me? I am thinking to retain a representative on my behalf either a lawyer or my agent to deal with this issue in my absence.

Any thoughts, guys?

It is the court to solve the issue and no one else. The fact that you are a foreign worker doesn't not mean that anyone can threaten you. Canada is one most developed country also in the area of protecting human rights.

You definitely need a representative if he takes you to court. Otherwise he can say everything he wants and you can't defend yourself and may end up with a judgement against you to pay.

If it looks like it's going to court, retain a lawyer or somebody who can represent you and show up in court on your behalf and dispute the charges to minimize your damages.

Thanks Leon, yes, I will find a rep on my behalf next week, in particular, I am leaving the country and all the court correspondence is through mail, it is better to have a rep to defend for me.

I think you are better off discussing your case with the tenants board, a lawyer or somebody else who knows the system before you leave so you know what you can expect.

Yes, we had already discussed with the agent in the board over the phone, but since the landlord and husband listing agent is going yo take legal action against us, we will talk to the lawyer in the board in details to get concrete suggestion.
