Hello All,

Here's my case - I am on TRV & work permit, and have applied for a PR this month (October 2016). My employer specific work permit is valid till Aug 2017. However, I may not have a job after the end of Jan 2017. Can I still stay in Canada on my valid TRV? and if yes what additional paper work will I need? Asfaik, I can only apply for an open work permit 3 months before my employer specific work permit expires, if I have put in an application for a PR.

I will appreciate if anyone can guide me on this (if possible with cic links as well).

Yes - you can remain in Canada without working. No additional paperwork required.

If you want to work for a different employer then that employer will need to obtain an approved LMIA so that you can apply for a new work permit.

I'm in the same situation. Recently I called CIC and the agent told me that I should change my status as soon as I quit the job. Be careful, I saw a lot of topics here with similar questions with wrong answers.

Unfortunately the CIC agents give out wrong information far too often. We generally advise not to rely on their answers for all but the simplest questions.

But they are kind of the official information. Well even if this information is not correct, where is the guaranty that the agent who processes the PR application knows it?

They are poorly trained call centre workers, not visa officers. They constantly give out incorrect information.

A person with a valid work permit may remain in Canada until the permit expires or until IRCC formally revokes it. There is no requirement to remain employed for the permit to remain valid.

Thank you for the responses. If any of you have a link from CIC stating what you are saying, that would be great. I want to make sure I am reporting my status to the government here as I am required to.

I was able to speak to an agent today on this issue and was told that I can stay in Canada. However, I cannot apply for an open work permit 4 months before the current one expires. I may have to remain unemployed until I can get the open work permit or find another job with a closed work permit (for the next 3 months in my case or till I get the PR).

Please share if anyone found a way around this.

Its been 3 months I have applied for a PR. Waiting on a response. Do you hear any response before the end of six months in general?

I did not apply for PR as his dependant, though. It's an individual application. We got married less than a month ago. I do have to inform CIC of my marital status but I am not sure what it changes in my case. Please share if you have any knowledge on this.

Also, I was told I am free to move in and out of the country as long as my TRV or permit is valid, even though I don't actually have a job. Please share if you have experienced otherwise.

No, there is no way around the requirements.

No, you can't get a work permit just because your spouse is Canadian.

While there is never a guarantee of entry, yes, you can leave and then return to Canada.

Hmm. This is surprising though. I know spouses of PR`s are eligible to get open work permit. I was hoping spouses of citizens would be eligible too.

1. The only way that a spouse of a PR or Citizen would get a work permit (other than through LMIA or PGWP) is if they were being sponsored in CANADA, have valid status, and included a work permit application with the sponsorship.

As said above, a person can apply for an OWP along with an inland sponsorship app. However, there is no way to qualify for an OWP based solely on being married to a Canadian citizen/PR.

Yes, I come to know this after speaking with a different agent. I guess he had better knowledge than the previous one. But this takes 4 months after the sponsorship application is in. So, it seems worse than what I currently have. Also, I was told that after I am at a certain stage in my PR application, I could apply for an open work permit. The stage is something on the lines of eligibility assessment. Which he said should be done any moment now in my case as he said. Also, I live in Quebec right now. Now sure how that will change things.

Anyone been through express entry process while applying from Quebec?
