So it's the same issue again.
I did not declare my partner in my application before.
The thing here is, is there anyway that i can sponsor her?

First option
Marry her somewhere that supports same sex marriage.

Second option
Apply her as tourist here in canada. And marry her here. Will that be possible?
Then she'll go back to the our country and finish her degree.

Third option
Consult to a immigration office and write a petition that our relationship wasn't declared because of circumstances that our community does not support same sex relationship.
I am really scared of this third option coz im risking everything here. Once she got denied i cant sponsor her even i marry her..

what's your status in Canada? i go with first option..apply US visa for her first, then marry her there.. then apply a trv for her in canada, that time, ur already married. bigger chance that she'll get approved.

hi! i've read that you're from Philippines. mas madali ung sinabi ko sau sa itaas. let her apply US visa sa atin. padalhan mo sya ng letter of invitation that you will meet her sa US because ur planning to marry her there. mahihirapan sya makakuha ng trv sa canada, kung plano mo jan sya pakasalan. fiancee visa is a no-no sa Canada.. pero sa US madali lng.. bakit alam ko? because we're in the same shoes... i married my wife here in the US..

ang problema kc, ang need nila kapag common-law partnership, meron kau mga properties and joint accts. dito lang talaga sa US pinakamadali if you will push thru with ur first option.. at yan lng din ang tatanggapin ng Canada sa case natin.

madali lng mag apply ng US visa, sa case mo PR ka na ng Canada, sisiw na lng from there. when I applied my wife for a US visa, di pa naman kami kasal, letter of invitation lng ginawa ko. tinanggap naman ng US, approved agad. single din naman sya.. need mo lang talaga ipadala and iattach lahat ng financial docs, bank statements, everything na magpprove na ikaw sasagot sa lahat ng gastos nya while the 2 of you will meet and go to US.

None of the options will work. You failed to declare her, so she is banned forever to be sponsored by you under family class. This is a very simple rule with many examples of it being strictly enforced when people try to appeal it. Doesn't matter if you get married, once IRCC sees you've lived together over 1 year as a couple before you landed as a PR, her app will be rejected. Philippines not supporting common-law rules of their own is not relevant, you were still legally common-law under Canadian law.

Also since you committed misrepresentation, your own PR status may be in jeopardy after IRCC finds out about it. If you got PR as a dependent (say in a parents application), then you would not have qualified as dependent if IRCC knew you were in a common-law relationship at the time and should never have got PR in the first place.

Best option is for her to look to immigrate independently under an economic stream, and not push the issue with IRCC.
