CIC says Police Certificate must be at most 3 months old as at submission date. For applicant who lived in UK and who has police certificate dated september 2009 and who never returned to UK, will new police certificate need to be obtained if i apply for PR in august 2010 i.e. within one year of issuance. It does not make sense that I have to get new police certificates since applicant never returned to UK. The existing police clearance certificate has no expiry date, it only has an issuance date. Can i still use it?

No, it doesn't matter that you claim you haven't been to the UK, the PCC can't be older than 3 months when submitted.
