Hi all,

I'm writing this to kindly ask for your wise advices.

My goal is to bring my dad here to Canada;

my parents had divorced in 1999 and my mom had remarried and moved to Canada with my step dad's family (including my self) in 2001. my step dad had sponsored my mom and myself and we've received a PR in 2003 and received a citizenship in 2009.
my mom and step dad had decided to separated in 2015 (legally divorced).

now my parents is in their 60's and now I'm trying to bring my dad here to Canada so that he can stay close with his family. however, I'm not eligible to sponsor him yet as I was away for a year so my income is not enough to sponsor him so I've talking to my mom to sponsor him so that he could move here quicker.

but she has been receiving a welfare (for a year) and I'm unsure how this would effect to apply for a sponsorship and how would my parents's marriage back in Korea and my mom's marriage with my step dad in here.

I would really appreciate if you can kindly help me to bring my dad here.

Your mother and father divorced a long time ago and they are no longer in a relationship. She cannot sponsor your father. If she tries to sponsor him - that will be fraud. CIC will see through that fraud pretty quickly and refuse the application.

You will have to wait until you meed the minimum income requirements to sponsor your father, then enter the lottery and wait to be selected - and then apply to sponsor him.

One thing that I didn’t mention in the tread that is they started to talk again since last year and its been going really well and i think they are trying to work it out to get back together.
If they decided get back together, does still count as fraud sponsoring him?

As of now they are divorced so she simply does not qualify to sponsor him.

If at some point they got married, or lived together 12 months to become common-law, then she would be eligible to sponsor him for PR.

The app would receive extra scrutiny due to her previous marriage to him. They would need to prove their current relationship was genuine, and convince a visa officer it was not entered into solely for immigration purposes so he could apply for PR.

So yes it's possible and would not be fraud if they were genuinely together again, however there would be some obvious red flags to overcome so app may face difficulties.

Also, your mom would need to be completely off any welfare/social assistance, in order to be eligible as a sponsor. She would need to convince a visa officer they would have means to support themselves in Canada so she would not go back on welfare after he got PR.

The relationship would have to be genuine - and not simply entered into for the purposes of facilitating his immigration to Canada.

That means that they would either have to live together for a full year - or get remarried before applying. If they get remarried - they would also need to spend quite a bit of time together to ensure they can demonstrate it's a genuine relationship again. Simply marrying and then applying immediately won't work.

And yes - your mother would have to get off social assistance and stay off.

If they decided to get remarry (which is what I'm really hoping for) do you think they should spend some time together before apply for the sponsorship (my dad came to Canada Mar.26 2018)

Definitely yes. They will need to prove they are a genuine married couple, and didn't just get married for immigration purposes. Spending as much time as possible together and gathering proofs of a legitimate relationship, would be needed.

Yes - they were previously married. However they've divorced and living separately for a very long time. CIC may have concerned this is a re-marriage of convenience. I would recommend they visit each other a few times before re-marrying.

No - your father will not qualify for a work visa just because he's married to your mother. They will need to submit an inland sponsorship application and an open work permit. The OWP will be approved around four months after the complete application has been approved.
