Hi everyone,

I have come here anticipating some guidance on my TRV application.

i was in Canada from 2012-2017 (study permit and work permit) my work permit expired and i came back to india and recently i got married 3 months back, my husband is Canadian PR and we filed for my PR application, currently its in the process, since it takes 6-8 months we applied for TRV twice but they have rejected both the times...

i recently came across CAN+ visa category... i have USA B1/B2 visa and travelled USA while i was in Canada, is it recommended to apply under CAN PLUS category ? or any other suggestion

please share your experience! i really appreciate your suggestions/inputs.

Hi,

Sorry to hear you were refused twice. Unfortunately, it is not surprising considering you have a PR app in progress.

CAN+ is only to expedite the processing time. There are no guarantees that an application will be processed under CAN+ even if the applicant has visited Canada earlier or has a valid US visa.

Realistically speaking (no intention to discourage you), I recommend you do NOT reapply for a TRV as your chances for approval are low. Do wait out the PR process instead

it was refused within 5 business days (both the times it was refused in 5 days)

Unsure if you applied for spousal sponsorship or PR on you own. Unfortunately if it is spousal sponsorship you are looking at more like 12 months.

it was TRV application.. but my PR file was in the process when i applied for TRV and they refused it within 5 days

You mentioned you applied for PR. If you applied for PR through spousal sponsorship it will take approximately 12 months.

We will start the spousal sponsorship process in the next 2-3 months. I had the following queries regarding this matter:

1. Can we apply for her TRV while we are staying in Canada? What are the chances of getting the visa approved?
2. Can we apply for a multiple entry TRP?
3. Should we mention that we are planning to apply to for spousal sponsorship? If yes, will this affect her visa application?
4. If her visa is approved, will her spousal sponsorship get affected in the future?

1. Sure, right on go ahead and apply online from the US. Approval chances depend on her employment (not familiar if H4 allows her to work), finances, etc.
2. You can't explicitly ask for one, but it will be up to the assessing officer to decide. By default, you're applying for a multiple-entry TRV.
3. Ooof, I'm not sure, but even if you don't mention it, CIC will connect the dots. You'll have to look around for other cases, but from what I understand, the reason why spouses of PRs usually get denied TRVs is because CIC would rather go the spousal sponsorship route instead.
4. No, and it won't get affected either if her TRV is denied...unless you result in multiple successive applications that result in multiple denials.

One of the factors that you must show when getting a TRV is a stong ties to your home country. Since you have been in the US and not in your home country that may be a hurdle.
