Hi guys,
Me and my husband are living in canada on open work permit status, and we have applied visitor visa for my mom on June 6th 2017 for the period of 3 months to visit canada as im expecting baby on Sept 12, 2017 and visa got rejected. Again i applied on July 17th 2017 with all the supporting documents and got rejected for 2nd time too.

1st time rejection stating insufficient funds and lack of my mom and host income and assets.

Next time i have attached all the supporting documents of my husband with T4, Employment letter, pay stubs. As im on maternity, im not working so i have attached my previous T4 forms.. and i have included my mom's suporting docs with CA report, funds upto CAD $20,000 in savings account and IT forms from the home country mentioning she will bare her own expenses for the entire trip. My mom is living in India and recently got retired in May 2017 and my father passed away in 2014 from then she is living with my younger brother who is working for Govt organization in india.

2nd time rejection stating that VO is not satisfied that she will not leave canada at the end of her stay based on
Travel History
Personal assets and financial status
Family ties in canada and country of residence.
I am not sure that she will get visa approved if i reapply.. plz help me to find any suggestion or possibility of getting visa...

Asking for three months for a visit is a non starter. If you have mentioned she will be here to help with the baby, that's another non starter (working illegally). With you and your husband, and a new baby in Canada, most of her family ties are no in Canada and not India. You will need to reduce the time requested to 2-3 weeks and provide very strong proof she won't overstay. I'd order GCMS notes to address the actual reasons from the VO before I tried again.

As your mom retired recently + your dad passed away, her ties to India have reduced significantly. Your brother who is not a minor + he is employed is not a strong family tie to return to.

You'll need to post the list of documents particularly those which your mom submitted + what reasons did your mom show to return to India

Hi Bryanna, thanks for your response.
My mom visa was refused under 179(b)
These are the list of documents submitted:
1. Bank Statements with CAD $20,000 in savings account
2. CA Report with property details under my mom's name which is around INR 75,00,000 (CAD $145k) and past 3 years Tax forms.
3. Purpose of Visit (Doctor Note).
4. Proof of Relationship ( Passport, Birth Certificate ).
5. Invitation Letter from Me and My husband (including Employment Letter, Pay stubs, T4)
6. Affidavit from my mom with financial status and bearing her own expenses within her stay in Canada, and also employment ties to India mentioning that she is required to be physically present before the pension paying officer once in every year and to take care of her properties and incomes in India.
7. Passport.
8. Visa Pic

She has no intention to remain in Canada for long time. How can i convince the VO with strong proof that she will not overstay ? and what are the chances of getting visa approved if i reapply ? please help me with your suggestion. Thanks.

Hi,

Probably one of the main reasons she was refused was because she stated she wanted to visit to take care of you and your baby.

My suggestions:
1. The CA report will not work in isolation. It should be supported with the actual documentation (Property ownership documents + latest property tax receipts + property valuation (either by a property valuer or self-valuation) + market reports to support the indicative market rates cited for the valuation + any recent utility bills.

If the properties are not mortgaged then do highlight this point as it could indicate a strong financial situation.

2. Purpose of visit: Typical tourist and spend time with you and your family. Do prepare a day-by-day detailed itinerary for sightseeing, etc

3. Does your mom's bank statements match her ITRs and her income? Was any of the money transferred from another bank account or borrowed from someone?

4. Does your mom have other financial investments: FDs, RDs, PPF, shares/stocks, mutual funds, LIC, insurance policies, etc?

5. Does your mom earn rental income/rented her property?

6. When does she have to be present for the pension renewal?

7. Has your mom claimed her gratuity, provident fund, etc?

8. Can your mom prove a must-return-by-date for a specific reason?

Cheers

Hi,

Thanks for detailed information you have provided.

1. My mom is having a Plot on her own with no mortgage.

And also, there is house she is residing now is on my mom and dad’s name that is not mentioned in the CA report before, which need to be changed under my mom’s name in future as there should not be any property under deceased person. (which includes house tax & Utility bills). So, I will also include this property details while reapplying.

2. Purpose of visit: Is it ok if I change a word to tourist for sightseeing? as I have applied twice for visitor visa mentioning about my due date and taking care of me and my baby.

3. Yes, my mom’s bank statements are matching her ITRs and Income. And money is not borrowed or transferred from anyone. Finances are in her savings account from more than 2 years, which got claimed from my dad’s PF and gratuity.

4. She is having PF, LIC, Insurance policies on her name.

5. She doesn’t earn any rental income on her property.

6. She has to be present once in every year for pension renewal, but there is no specific date mentioned to appear the pension paying officer.

7. As she recently got retired, she already applied for her gratuity and PF which is not claimed yet.

8. I will try to find specific reason to prove must-return-by-date.

I will attach Cover Letter, Invitation letter and purpose of visit. And what more docs I can submit to prove VO that she will leave Canada at the end of her stay?

If you have any samples of Itinerary, Cover Letter, Invitation Letter and Purpose of visit, please forward me that could be helpful.

Thanks for your time
