TRV rejected - please help

Hi!
My spouse's TRV has been rejected in one week based on below:

I am not satisfied that you will leave Canada at the end of your stay as required by paragraph 179(b) of the IRPR (https://laws-lois.justice.gc.ca/eng/regulations/SOR-2002-227/ section-179.html).
I am refusing your application because you have not established that you will leave Canada, based on the following factors:
• You do not have significant family ties outside Canada.
• The purpose of your visit to Canada is not consistent with a temporary stay given the details you have provided in your application.

Spouse's Profile:
  • I am the main applicant and applied along with our toddler son. My visa has been approved in 5 weeks. Son's TRV is still being processed.
  • Later I added spouse's TRV application with the purpose of him to accommpany me and our son.
  • Spouse has an official employement (6 months bank statement with 0 in the account has been attached), letter from the Employer has been attached
  • Spouse has no one who lives in our home country, his mom lives in another country.
  • Our property is under my name (if relevant, spouse holds POA from me (did not mention this in LOE). He is a lawful heir to his mom's property (did not mention this in LOE)
  • Funds: all in my account (mentioned that as a family we keep funds in one saving account)
  • In LOE provided all the sincere info about the acommpanying purpose of trip for 3 weeks to help out with settlement, etc
  • As a main applicant I added the formal invitation for him.
I am yet to get GCMS notes, but please what might be improved in spouse's application?

If your spouse wants to come with you while you study he should be applying for an OWP.

Order GCMS notes. Are you in Canada because you cannot invite him if not in Canada? Why not SOWP? If you all applied together, your study permit may have been approved because your spouse/child are ties to return. His ties are weak to return because you are living in Canada. Don’t reapply until he has GCMS notes. Seems like he has no ties other than the employment letter.

Son’s TRV may be refused too based on the same reasons. You may want to come to Canada, get settled and then reapply.

Your spouse is employed but there's no money in his bank account? How do he feed himself with the toddler while you are away?

@canuck78 OWP processing time is too long, around 10 months. We want spouse to accompany us for Jan 24 intake, which obviously not gonna happen now :(

Oh no, I hope son’s visa will get approved, the application is at the last stage, according to processing times the decision shall be out in ~ month. Traveling without sonny is not an option, he is only 2.5 yrs old, he needs me for everything. Thank you for your tips

@steaky , here are the details: he feeds three of us with his monthly salary. When me and our toddler are gone he will only feed himself with his monthly salary.

So the employer pays him cash and he don't deposit the funds to his bank account. He gave his salary (most of it after feeding himself) to you and deposits into your bank account? So why bother for him to get a bank account?

So if son’s TRV is refused then order GCMS notes too. If not an option then you will have to decide whether to study in Canada. Writing a letter of invitation was not a great idea because you are not inviting him to Canada. His reason for refusal is that his family (you) are in Canada so he needs better ties to return.

Not sure what you mean by your husband only feeding himself when you are in Canada. How will you feed yourself and your child? Daycares operate Monday to Friday, during working hours so you will not be able to work many hours.

Ah no, I said above that we attached his bank statement where salary credits are being shown for the past 6 months. He just withdraws his salary every month and there is no funds currently. The company is international. It has branches all over the world.

No wonder the refusal. His income was just enough to pay for the expenses living in the home country. Nothing was saved.

So he has just enough to support himself. That will be one reason for refusal. Your funds are only enough to support yourself in Canada. He has not funds.

His mom’s property is not his and not a tie. He is a grown man. When do you think you will work full-time if studying full-time, and have a toddler that requires full-time day care? Your study permit was approved based on you being able to afford it, and your husband not accompanying you (ties to return). If son’s TRV is refused for same reason then it is because he is your tie to return. If approved, then come to Canada with your son.
