Need expert advice for reapplying, my MIL and FIL's visa got rejected with the below reasons...me, my wife and my son are PR since 2015, my wife's delivery date is in dev and we wanted to call our in-laws for moral support during that time. so i applied for a trv stating the stay would be for 5 months i.e nov 2018 to march 2019 (i assume that may be the reason for the rejection ?) also wanted to mention, my in laws doesn't have a job but have a business though and cannot show much of a proof of business or income as such. However, i had mentioned in the invite letter that i would be taking care of all the expenses during the stay, below are the reasons for rejection for my MIL,

1 -You have not satisfied me that you would leave Canada at the end of your stay as a temporary resident. In reaching this decision, I considered several factors, including:
2 - travel history
3 - Purpose of visit
4- Family ties in Canada and in country of residence

documents i submitted
my emp letter
bank letter showing $30k CAD
FIL and MIL's marriage cert and passports
FIL and MIL's other visas stamps(they had traveled to Saudi and kwi in the past for pilgrimage)
travel itenary ticket (with tentative dates)
me and my wife's pr copy

Iam planning to reapply only for my MIL's this time,
for the reason - Family ties in Canada and in country of residence, can i mention that she has to go back to take care of her husband and old mother in law ?
i still did not understand what do they mean by Travel history ?
in the first application, for the purpose of visit i mentioned that they are here for tourism purposes only coz if i mention that they are coming to support my wife's delivery, it might be a benefit of doubt for immigration officer that they are coming as caregivers and might extend ?

please suggest what info i need to add?

Pregnancy + wanting to visit for 5 months = Double reasons for the refusals.

Moral support can be long-distance too + you already have one son i.e. it's pretty obvious that your in-laws would like to visit to take care of your wife/your new baby.

Evidence is necessary to support any claims.

Applicants must demonstrate adequate funds to pay for the visit.

If your dad-in-law was good to travel earlier, it may not make too much sense in presenting him as someone who needs taking care of in your MIL's new application.

Was the elderly MIL of your MIL mentioned earlier as a reason to return?
Does the MIL of your MIL live with them?


i still did not understand what do they mean by Travel history ?
Travel History means short-travel to visa-required countries such as the US, UK, Schengen, Australia, NZ, etc.

Their travel to Saudi Arabia won't count.

It's not advisable to mention your wife's pregnancy. But, unfortunately, the damage has been done.

IMO, your MIL must not reapply so quickly. The visa officer may not be convinced by the new purpose of visit.


1. Does she own property? Or has a lease agreement in her name? If yes, does she pay the bills?
2. Does she have any financial investments like bank term deposits, shares, mutual funds, insurance policies, etc?
3. Does she have any compelling reason to return to her home country by a specific date?
4. What other ties can she demonstrate?

do you think reapplying with 3 to 4 weeks stay + explanation of family ties back home would help ?

what would you suggest the best possible direction i should be going now ? i was aiming to have her come here by Dec, but looks like the possibility is unlikely ... kindly advice

It won't be convincing because there are other family members who could take care of the elderly MIL.

IMO, your MIL does not have any ties to return to.

Applying too soon would make it obvious that the purpose and duration of the visit has been changed + she can stay for 5 months or more (original duration) as she does not have any ties to return to.

IMO, there are two scenarios:
1. Wait for a couple of months before your MIL reapplies. Your wife has already been through one pregnancy and she would know how to cope with the current pregnancy.

When your MIL reapplies:
a. Her visit must be for 3-4 weeks max. with a detailed day-by-day itinerary with expense estimates
b. She must prove she can pay for the visit with the financial support of an immediate family member in her home country
c. She must include 2-3 compelling reasons to return to her home country with evidence


2. You may want to consider applying for your sister-in-law after a couple of months instead of reapplying for your MIL. The sister-in-law can prove ties such as her children + employment (if that's the case) + finances + a short visit

@Bryanna - its been close to 2 month after the first rejection. do you think is it good idea to reapply now for my MIL with the below reasons...

Duration - 3 to 4 weeks
Reason - same as before, tourism ? or be honest with the pregnancy reason ?
family ties back home - had to go back and support husband, daughter and old mother in law ?

i cant invite my sister in law,as its of no use technically. only option is to invite my MIL....

kindly advice.....
 
One of the big issues is that your MIL and FIL need to be able to show that they can pay for the whole visit themselves plus have other savings. That doesn't seem to be the case.
