TRV refused twice; now considering student permit

I've been refused twice in my TRV applications in the past two months. I have a Canadian boyfriend who wanted me to take a month of vacation in his country, but because the majority of testimonials and stories we heard from the ones who were also in a relationship with someone who's inviting them to Canada resulted to visa refusal, we decided to have me apply as a solo tourist (without declaring anything about my boyfriend). I applied, which was my first visa application, in July. Unfortunately, I was denied with 4 reasons such as family ties, travel history, financial assets, and purpose of visit.

After a month, I reapplied, but this time around having my boyfriend as my inviter/sponsor. I just included in my cover letter, together with my explanations addressing the 4 refusal reason, my explaination as to why I decided not to declare him in my first application and why I was declaring him in my current application. We submitted all the important documents of his, together with mine and everything that proved the authenticity and length of our relationship, as well as a Letter of Support from their MP (Member of Parliament). Again, I was denied and the refusal reasons were the same as the previous ones except my financial assets which was replaced with two new reasons such as my employment status (when there was nothing changed in my employment upon my 2nd application and when they did not include that as one of the reasons in my 1st application; they were inconsistent on this part.) and that they did not believe I answered the questions truthfully (which we were wondering which questions were they referring to).

We were so devastated and disheartened. :( Early this September, just a few days after we received my second refusal email, my boyfriend requested online for ATIP (Access to Information and Privacy) to get the detailed reason of my recent visa refusal so we could see if we could make an appeal. Hasn't received it yet tho as it would take up to a month to receive it.

While waiting, we're considering other option which is to apply for a study permit. I'm just worried tho that the visa officer would take my previous TRV refusals against my study permit application and eventually refuse me once again. What do you guys think?

The two TRV refusals will work against you when you apply for the study permit. You will want to put together a very strong study permit application ensuring your planned studies in Canada make sense in light of your previous education and work experience. What you take in Canada should be a progression of your past studies (e.g. if you have a bachelor degree - you should be taking a masters here). You'll need to show a bank balance of at least $25,000 (possibly more) to be approved to show you can cover living expenses and first year tuition. You'll also need to show strong ties to your home country - same as required for the TRV.

The two TRV refusals will work against you when you apply for the study permit. I was actually considering the Healthcare Aid (certificate program) if I were to push through with the study permit. It's the closest study that I know is the cheapest (at least in Winnipeg where I would intend to study) and I think will make sense in light of my previous 6-month Caregiving Training here in my home country. However, I also worry about declaring my past caregiving training as the officer might think I intend to not leave Canada after my Healthcare Aid program. Please correct me if I'm wrong about my assumptions.

If you apply to come here for a simple certificate - then I think you'll be refused. It will look like you're taking the minimum education needed and the lowest cost possible just to get here and that you're just using the study permit process since the TRVs have been refused. IMO IRCC won't think you are a genuine student.

To have a fair chance of getting approved given the two TRV refusals and your profile, I think you would want to be applying to complete a bachelor degree here - or a masters if you already have a bachelor degree.

IMO IRCC won't think you are a genuine student.

Thank you for your thoughts, @scylla . But that's the only study I can currently afford. :( I think my chance of coming to Canada is getting thinner. :(

In my opinion, there's no point in applying for a study permit for the certificate. I think refusal is guaranteed.

I see you posted your background in another thread. Given you have a bachelor degree and are currently working in marketing - IRCC will think your planned studies in Canada don't make sense. And when it comes right down to it - IRCC won't be wrong. The only reason you're considering a study permit now is because the TRV has been refused.

Anyway - just my opinion. If your relationship with your boyfriend is serious - get married and have him sponsor you for PR as his spouse.

In my opinion, there's no point in applying for a study permit for the certificate. I think refusal is guaranteed.
