TRV for Colombian resident refused...couple questions

Hi All,

Thanks for the guidance up to now about maneuvering through the confusing application process.

I'm helping a friend obtain a TRV to come and visit. we supplied what we thought was enough to support the application for a 2 week visit.

Employment letter, invitation letter and supporting info, itinerary, proof of relationship, extra proof of upcoming surgery for a pet dog that will require extensive post op care from a registered vet, all of the other required docs.

Refusal reasons:

• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your travel history.

I'm assuming because she hasn't traveled with her new passport, it's a strike. QUESTION: We're going to Cuba April 2-9. Does this destination offer any better proof of travel if she reapplies when she returns with Cuba stamp?

She supplied 3 months of bank statements instead of 4 because she switched banks 3 months ago and couldn't get 4 months to supply. I know she should have waited. QUESTION: Could this be attributed to the amount of money in her bank account PLUS the 3 out of 4 bank statements? I understand from other posts that when she applies, she should have $1000/week of her stay that's satisfactory?

We will have her reapply after the Cuba trip when she has 4 months of statements and and proof of travel to Cuba. I assume she'll need to show more proof of sufficient funds in her bank account upon reapplying?

Thanks in advance. I hope you can help clear the muddy waters of this process.

Cuba doesn't count as convincing travel history. Has she travelled to the US, UK, Europe/Schengen, or Australia before? Those are the kind of travels that IRCC wants to see instead.

Sounds like IRCC doesn't sound convinced either on the amount in her bank account.

FWIW, I also supplied 3 months of bank statements because I didn't know about the 4 months recommendation. It's not really how far back you give, but the profile as a whole.

CIC probably suspects this is a boyfriend / girlfriend situation and has concerns she has plans to marry you and remain in Canada long term. I think you probably have quite a bit to overcome to get an approval.

CIC probably suspects this is a boyfriend / girlfriend situation and has concerns she has plans to marry you and remain in Canada long term. I think you probably have quite a bit to overcome to get an approval.
Would they not list that regarding proof of relationship as a reason rather than lack of travel and financial situation?

So this could mean either multiple attempts or we apply on different grounds?

No, she's 24 and never been out of the country,

Thanks, but from what I've read, do they actually include notes or just arbitrarily refuse based n the grounds they list? Think seeing the notes would really help if there were any?

If we decide for a permanent resident visa instead based on spousal grounds, does this help any?

If we take some time and decide to marry, how much more difficult does the process get.......or easier?

If you get married and sponsor her for PR, this will not increase the likelihood of a TRV approval. If anything, it will further reduce the chances of approval. TRVs are for individuals who want to come to Canada as tourists only and have no plans on remaining in Canada long term.

Sponsoring her for PR once you are married will take approximately a year. You should have no issues being approved provided your relationship is genuine.

Typically the notes include details of exactly why someone was refused. Your refusal really wasn't that arbitrary. Your girlfriend is single, has no travel history and few ties to her home country. And you did in fact plan to possibly get married or live common law in Canada if the TRV was approved per your earlier posts. So CIC was correct in guessing she wasn't a genuine tourist. They've seen too many people with her profile try this in the past.

If your relationship is serious, get married an sponsor her for PR.

There's a great deal CIC has to assess. First, whether you qualify as a sponsor, the whether your relationship is genuine, she needs to complete a medical which will also be assessed and provide police certificates. CIC will also conduct a background and security check which is far far more thorough than that conducted for a TRV. So quite a lot more involved than a simple TRV.

Thanks so much. I think it's futile to keep trying to challenge and overcome the issues of the TRV when she doesn't have a travel history. I may still apply to get the notes of the refusal but doubt it makes much of a difference at this point. It's defeating really.

I'll join the family sponsorship forum to ask some questions. My biggest concern now is the rate of refusal in a spousal sponsorship situation and why. It;s super frustrating to be with someone you love and they constantly get turned down to even visit here let alone live. She's healthy, college educated and willing and able to work and contribute to society. A year is an eternity.
