TRV extension questions

Hi everyone,

My partner posted on here last year with some questions about his visit to Canada, and now I’ve got a couple of questions. He arrived in autumn of last year with a return ticket for 2 months later. We ended up changing his flight to the end of his 6 month visitor period because things were going so well. We’re just about to submit a TRV extension request and I’m wondering the following :

1. We’d eventually like to apply for common law sponsorship (I’m a Canadian citizen). Obviously we need to live together for at least 12 months, so a 6 or 7 month TRV extension would allow us to do this. As far as people have experienced, is CIC still accepting “we’d like to fulfill the 12 month cohabitation stipulation” as a valid reason for wanting an extension? I am guessing that this falls under the concept of dual intent? I just thought I'd see what people's recent experiences were.

2. We’re a little worried about being able to adequately demonstrate strong ties to his home country. He doesn’t own property, but he does have family, including several younger (i..e under the age of 10) siblings, and all of his friends back there. He also has a return ticket to his home country that he can change the date of depending on what happens. What else would prove ties?

3. If we submit the extension request a little less than 30 days before his status runs out, is that okay? I’m getting a significant raise on March 1, so the Letter of Employment that I generate on that day will be much more reflective of my financial situation going forwards.

Other relevant points : he’s traveled to the USA (and still has a valid American visa), Asia, and Canada before and always left when he was supposed to . Between us, we have over $100,000 in savings, so funds aren’t an issue. We'd like to do everything by the book, and he will obviously leave if the extension doesn't go through.

He will be applying for an extension of his visitor status, not a TRV extension.

1. Yes, wanting to become common-law is a valid reason for applying. He should ask for a year to be able to become common-law and get the application submitted.

2. Extension apps don't really focus on home country ties, especially when a person is basically stating that they are trying to stay here permanently. The key part is showing a valid reason for requesting the extension and the financial capability to support the extended stay.

3. He can apply up until his status actually expires.

Thanks for the answers. I really appreciate your advice, and I think you've put our minds at ease a little bit. We were reading over the CIC site last night trying to reconcile the "ties to home country" with the fact that we're declaring that I intend to sponsor him, so what you said makes sense.

If i receive multiple entry visa where you can travel for six months come back to home country and go back again after 6 months,

my question is, for my first visit to canada when will that duration of 6 month start, from the day Visa gets stamped on Passport or
from the day we land to Canada?

The day you land in Canada but do not assume you will get a 6 month stay given that is at the discretion of the CBSA officer at the entry point, could be less than 6 months. Depends on your responses to CBSA at the time such as purpose of visit, funds for a long stay, return ticket and so on all standard questions.

Also note there is no specific return time for a multiple entry visa, you could stay away for days/months/ years but you will still be assessed afresh on each entry. Obviously returning in days versus months you would get more scrutiny about your intentions hence recommendation to stay away for a few months as a visitor.

Hi everyone - I just wanted to thank you guys for your help. We received the extension a little under a month after applying. It's valid for another six months, at which point we will need to apply again (I think it expires one day before we are eligible to apply for PR) and then get started on the PR process.
