TRV before PR query

Hi,

I posted this query in a thread that I think may now be dead, so apologies for cross-posting here.

I have just had my wife's outland family class PR application sent back for a missing document. I misunderstood the requirement for including the birth certificates of children who are over the age of 21 and not supported by us, apparently.

I am now thinking of applying for a TRV for her now and then applying for inland once she arrives here.

I'm wondering:

1) Is this advisable? I'm guessing her chances of success are diminished as we are already married, but others in our circumstance have received approval and at least we would find out quickly either way.

2) Would she be able to apply for extensions once here to cover the time the PR application is in process? (I take it this would mean she could not leave the country while this is in process, which would be acceptable).

3) And finally: Would I be able to be refunded for the initial PR app or transfer that payment to the inland?

1.) Chances of visitor visa approval is very low with you living inside Canada.....as your spouse is highly likely to overstay since she has a strong ties to Canada.

2.) if she is able to enter Canada with visitor visa.....she could apply for visitor visa extension.....and if IRCC receives your inland sponsorship with OWP application when her visitor status is still valid, she will have implied status......for inland sponsorship both Sponsor and PA must be living inside Canada and the PA is expected to remain inside Canada while the sponsorship is being processed.

3.) If IRCC has not refunded your fee payment for your returned sponsorship application......you could use the earlier payment for your new sponsorship.....just include a copy of the payment receipt in your sponsorship package.

OWP is open work permit. It helps applicants who want to work while waiting for their PR application.

It is highly, highly, highly unlikely that they will give your wife TRV. Speaking from experience. I would recommend just re-submitting the spousal app and waiting it out (though you may not want to be apart). The TRV will waste your time.

Thanks Ayat. Yes, I had that suspicion and now it's pretty concrete. I'll do that, I think. From what I can gather, there is just as much (or as little) chance of her getting a TRV before the spousal PR app is filed as there would be before. So I'm going to re-file the PR, await the sponsor approval on that, and then take a gamble by trying for a TRV while that's in process. It's likely going to be rejected, of course, but it's not a big expense, and one never knows.... maybe I'll be lucky.
