TRV applied - got Procedural Fairness Letter

Good day Everyone,

Here is my timeline:

13 Dec 2015 - Applied online for Temporary Resident Visa (Visitor Visa)
14 Dec 2015 - Received BioMetrics Request for me and my wife
15 Dec 2015 - Application submitted successfully for me, my wife and my kids
21 Dec 2015 - Received Procedural Fairness letter
21 Dec 2015 - Respond back to CIC

04th Jan 2016 - Still Waiting for Final Decision

Actually, I didn't tell them about my denied entry from United States of America in 2005. And they find my removal from background check. I was really confused either i should tell them about previous removal from USA or not. Since they find my removal and send me Procedural Fairness letter.

As i received Fairness letter, i replied them immediately with apology mail and also submit all other documents which i was hiding from them.

Could you please tell me how long they will take in giving me their Final Decision? I can see in my E-CAS, my application status is still OPEN. I am sure they will refuse or cancel my application and there is possibility I can get Five years ban and can make me Inadmissible.

"paragraph 40(2)(a) specifies that the foreign national continues to be inadmissible
for misrepresentation for a period of five years following, in the case of a determination outside
Canada, a final determination of inadmissibility under subsection (1)."

But I really want to know why they are taking so long in getting back to me? They give me an opportunity to send them supported documents and they give 15 days to respond them:

"Before I make my final decision, you have the opportunity to submit additional documents or
information relating to the above. You must do so in writing within fifteen (15) days of the date of
this letter. If you choose not to respond with additional information, a decision will be rendered in
your application based on the information before us."

Please tell me why they are taking so long in giving me their Final Decision

Hi,

A removal/deportation is a serious matter. Not disclosing it could be considered as misrepresentation. The US and Canada share immigration records. You should've disclosed the US entry denied/removal before CIC issued a 'Procedural Fairness Letter'.

If you're lucky, you'll be let off with just a TRV refusal. In a worse case, you could get a 5-year ban from entering Canada. We have seen the second possibility happening even when someone had not disclosed a H1B refusal.

There's nothing you can do. You'll have to wait until CIC contacts you

Hi Akashan,

Same kind of thing happened to me as well. I was denied a US visitor visa but didn't mention that in application and got a procedural fairness letter. I submitted all the application on 15 feb 2016 and still waiting for their reply. Did you hear back from them? I am just curious how much time it takes after procedural fairness process.

Akashan's application was refused and he was banned from Canada for 5 years for misrepresentation.

It has almost been a month and no msg from them!

It can take a few months for them to respond.
