I dont know his whereabouts . I wasnt married to him anyways and besides he is not giving any support to our kid . Would there be a problem ? I m not familiar with Canada law re this situation of mine . Pls help.
Despite Philippine law says that a mother gets automatic parental custody of illegitimate child, CIC won't focus on this alone and would just simply accept that you are free to take your child with you when you immigrate to Canada. What you need to do would be:
1. Do your best to get a hold of the birth father.
TIP: When you get a hold of the father, be nice as much as you can so you get him to sign the IMM 5604. Said form must be notarize and attach a valid identification of the birth Dad.
2. Execute an Affidavit of Illegitimacy and Sole Parental Authority. Please note that there is no guarantee CIC will accept this.
If you're able to accomplish no. 1 item, that would be a relief for you.
