Travelling out of canada with expired worker visa.

Hey there everyone,

I am stuck in kind of a weird situation, i came here on the work permit in 2019 , which got expired on 19th march 2021 and my worker visa got expired on 16th february 2021, but i have got my new work permit by the same employer valid till 2023 and i had applied for the visa renewal before i got the my new work permit in hand, but i haven't got my new worker visa till now. Now all of a sudden my employer decided not to continue my services as an employee & i didn't know these things are going to happen. i had already applied for 4 weeks vacation to go to my country & got approval for the same. i have booked my tickets also. i want to ask, as i am going to go to board the plain, with the expired worker visa on which validity date is 16th february 2021,
(1) can this result into deportation ?
(2) will this mess have any adverse effect at the time of entry into canada in the future ? could this be the reason of inadmissiblity into canada in the future?
Please help i am in a state of shock and depression.

Give the travel restrictions you could be denied boarding. To be qualify to travel to Canada you will need to prove that you are currently living in Canada like a current lease, car rental, bills, etc. If you want to guarantee that you won't have any problems entering Canada I would suggest delaying your vacation. As long as you have a work permit you can remain in Canada but can't work in Canada.

Hey, thanks for the reply. As i don't have a job now and i need to go to my country for some very very urgent work. After that i will try to search a new job in canada from my own country. So i want to know, as i have an expired worker visa , i have kind of overstayed my visa by almost 40 days but it wasn't intentional , i lost the job that's why. so is it by any chance possible that they'll hold me guilty of overstaying the visa and charge me for the same, which would affect my future travelling and working in canada?

Sorry about your situation.

But many details in your post are not clear.

Worker visa valid till Feb 16, 2021 -is this referring to the passport counterfoil?

Because you mention a work permit valid until 2023 — this is how long you are allowed to stay in Canada.

Boarding a plane with visa expired in Feb 16, 2021: are you talking about a plane to LEAVE Canada, or to ENTER Canada? Because it sounds like you are still in Canada.

To leave Canada, it does not matter. I’m not as qualified about temporary worker re-entries, but as far as I know, you cannot enter Canada on an expired visa even with a valid work permit. Someone can correct me if I’m wrong.

But you are still going on 4 weeks vacation during a pandemic, and while I can’t stop you, I’m not sure that’s wise given the restrictions to enter Canada. Just be prepared that if you do leave the country, it may be very difficult for you to come back.

I don’t think you overstayed your visa if your work permit was until 2023 and you were on implied status. Again, I’m just guessing what you actually mean because the original post is not very clear.

3) yes i am gonna leave canada for 4 weeks then i'll try to come back , i know this is not a good time to leave canada & my re entry into canada will be very difficult but my plan to travel is kind of inevitable due to some urgent work back home. what i wanted to ask is whether or not i could apply for new visa with this work permit from outside canada? and whether i am doing anything illegal while travelling with expired visa?

Are you on a closed or open work permit? If on a closed work permit, you will be asked for a job letter but can’t work when you enter Canada.

I am on a closed work permit, i have job offer letter with me and work permit valid till 2023. Will these documents still be vaild even though i have been fired from the job? Can i apply for new visa from outside canada?

So a closed work permit is tied to your employer. Is your new job with a new employer. If so, your employer needs a LMIA and you need a new closed work permit.

My employer extended the job for two more years supported by new lmia and new job offer ( i have job offer and lmia number which i used to get my work permit extended till 2023) but after 1 month last week he decided not to continue to have my services as employee.

So you don’t have a job. If you want to work in Canada, you need a new employer and LMIA.

Given the changing economic conditions and job losses you need recent proof that you are still employed.

Then you do not have a job offer of this new closed work permit any more. Since it's a closed work permit, your work permit is not valid any more (employer ended your job) .

Hello all
I recently got open work permit and have valid worker visa
I am planning a trip to US from April 2021 - May 2021
Currently I am unemployed but I can get job offer letter when re entering Canada in May
Will there be any issue to re-enter
