After get denied by TRV, If i will hire an immigration lawyer for PR application, can a lawyer request to record my interview with CIC? I have heard some horrible stories that there are some abusive interviewer? how can i guarantee that the interview is not an interrogation but rather a friendly approach?


(for my opinion, Interrogation often use by police or immigration officer if an individual did a crime.)

If you a hire a lawyer, be sure it is someone who is well versed in immigration law. Don't just pick the person who offers you the lowest fee, they often have no idea what they are talking about.

A lawyer would not be allowed in with you during an interview and I doubt the CIC officer conducting the interview would allow you to record it. However, keep in mind, that an interview is NOT always required. They are usually given when there are questions surrounding the information presented in the application or the validity of the relationship.

All of the questions you have asked have been answered and many folks won't engage on a thread to answer something that has already been answered. You have asked for other suggestions, however, you haven't been clear on what kind of suggestions you would like and in regards to what?

Thanks for the reply. i am asking if there is anything that is being missed on this thread, or anything they think will help to improve my case. My case is not ordinary heterosexual relationship that can easily managed by marriage. I cant marry the man i love in my country. Asia is largest numbers of transgender.

I will be applying TRV very soon (target date is April 2015) do i need to submit all of these: (I thought all the things i have should be submitted in PR)

-a land property in Florida (both our names are listed on the land deed)
-a house and lot under my name only
-traveled abroad and locally
-email, sms and chat conversation through skype
-pictures together
-money transfer records
-Forex cargo proofs (parcels)
-joint bank account including credit card
-insurance policy that i am his beneficiary
-notarized last will and testament
-power of attorney
-notarized affidavit coming from family and friends
-sworn affidavit stating that he is single and never married anyone in Canada
-certificate of no marriage stating i am single and i never got married here
-invitation letter from my boyfriend
-cover letter explaining reason of travelling


OR


-invitation letter from my boyfriend
-cover letter explaining reason of travelling
-a land property in Florida (both our names are listed on the land deed)
-a house and lot under my name only
-joint bank account including credit card

Do not apply with the first list of items. Those are related to PR and certainly not related to TRV.

The second list is more in line with what you will need, however, having property in your name in Florida isn't going to assure them you will return to the Phillipines once your 'visit' is over. Instead, include proof of the property you currently own in the Phillipines and also include a letter from your boss (if you work) stating that he/she is expecting you back on xxx date, or if you can't get that, include your pay stubs to show your ties to the Phillipines. Show them proof of funds that you have enough money in savings to support yourself while you 'visit' and also a letter in invitation from your boyfriend and a statement included therein that he will provide for your necessities while you visit will definitely help with your case.

If you include all of these things I see no reason why you would be denied a TRV unless you have a criminality issue.

As a side note, you keep identifying yourself as Transgendered, however, you have not stated if you are post op or pre op. If you have not yet actually gone through the physical change, then CIC will view your relationship with your boyfriend as that of a gay relationship. If you have already undergone gender reassignment, have you had any of your other documentation changed to reflect that? In that case, CIC will need an explanation from your boyfriend, as stated before, about the nature of the relationship and that he is aware of your status and such. Without a letter from him in this scenario, they may feel you are trying to 'trick' him and that may cause a huge delay in your application.

Thank you so much this helps. I dont have any criminal records. I will certainly include that i am a pre op transgender and my boyfriend knows that. Can we also include in the notarized invitation letter and my letter of intent promising the following:


-the purpose of the travel is solely for tourism and NOT getting married.
-i will not overstay for more than desired stay which is 3 weeks.
-i will not apply for any extension visa or any type of visa while i am in Canada.
-i will not work or accept work or look for a job under trv
-i will not commit any crime or violation and will always follow CANADA law
-Most importantly. i will come back after 3 weeks.

If you start stating what you promise to NOT do while you are here it's going to raise more questions which aren't necessary.

All you need do is include the proofs that are requested. Never never give them more information than what they are looking for. They expect that you know not to commit a crime or work. That is why you include adequate proof of funds so they won't even question it. CIC just doesn't accept peoples 'pinky' promises not to do something. Showing them that you have property and/or a job to return to tells them that you will return after your stated period of visitations.

The previous thread advised me not to tell that i want to get married in my trv application. You are saying that i should not put it in my cover letter but im sure CIC is good in digging things out during the interview. I DONT WANT TO LIE BUT I DONT WANT TO MISREPRESENT THINGS, Honestly, once they give me a trv id like to marry my bf there and go home in manila then apply for spousal visa.

Lastly, if the CIC asked me about get married during the trv or any plans of getting married while in trv? what should be the proper response when they start asking about marriage?

There is not going to be an interview when you apply for a TRV. You send in the application along with the proofs they require and then you await either your visa stamping or your denial letter. They don't interview for TRV.

You boyfriend does not go on either of those forms. You would not even include the 5409 in an application unless you were actually common law.
