Hello everyone!

My fiancée and I applied for a 2 week visit to Canada on the 4th of December at VFS and got our passports back with a letter of refusal on the 24th December. The reasons that the VO stated for the refusal are as follows;

• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your travel history.

• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on the purpose of your visit.

• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your personal assets and financial status.

We both got the same refusal letter with same reasons with just our perosnal details changed. This is my first refusal and I’m worried to reapply because they might just put my application away like “ahh we refused it once, how come he has new evidence or strong points this soon, so let’s refuse again without even going through what he has got to say”

Please advise me on reapplying? Should I go ahead and do it or should I just giveup?

Here’s the back story:

I was planning on visiting Japan with my family friends whom I have known since childhood and are permanent residents of Japan. I applied for Japan visit visa in July 2018 along with my friends parents and was granted a three month visit visa. I was working at the same place I work right now and I submitted leave approval letter (leave for the Japan tour was approved from 1st - 31st august 2018) and employment confirmation. During the month of august my office was going through some rough times and the director board requested me if at all possible to postpone my Japan tour and stay back with them to get back the client submissions on track. And since I love my job and workplace so much I was okay with it. Why not visit Japan some day later was my thought.

And last October, during a casual chat my superior officer asked me about the countries I would love to visit and stuff. And I was like Niagara is a dream to visit for both me and my fiancée. A few days later I got to know that i was granted an all expenses covered two week trip to Canada by my employer. This was as an appreciation to staying back during the hard times cancelling my Japan trip.

Having my wedding April next year, and my fiancées birthday in November, I thought I would surprise her with a two week canada trip because Niagara falls is right on top of her bucket list (I was overloaded with fiancée points - you know happy wife, happy life innit?) and then we applied for visas.

Travel History:

My fiancée has a fresh passport.

Me on the other hand has travelled to UK quite a few times (4 to be specific) becuase my dad is a British Citizen. 1 thailand visa and 1 unused Japanese visa. I started travelling on my moms passport the first time and later on my own passport. Of all the visits to UK I have not overstayed any. During the last visit which was in 2013 I tried to switch my visit visa to a dependent visa as I was 17 years and my dad had the finances to support me. I applied before my visit visa was expired so technically I didn’t over stay. Applications got rejected by the UKBA and we appealed went to a hearing, applied again, refused again, the process was costing alot for us and my time was just being wasted becuase I didn’t want to work or study illegally I just stayed at home while the UKBA approved me. Finally in 2016 I decided to voluterily withdraw and leave UK. Both my parents and my sibling is living in the UK having settled status. I am here doing my dream job and looking after my parents properties, marrying the love of my life, life is good.

Documents Submitted (applied as a group):

- two Completed applications
- Employment confirmation
- Two week travel plan
- Booking.com reservations (4 different hotels for the two weeks inorder to sync with the travel plan. These bookings were stamped by the company director to stay they approved the expenses)
- Return air tickets itinerary
- Letter from employer explaing the all expenses covered two week trip
- 3 months of employers bank statements (2 banks)
- land deed of my parents.
- valuation of the land.
- statements of remittances I get from my parents every month (around £1500/month)
- my personal bank book copies (around 1700CAD balance)
- my parents and my siblings British settled status proof. ( my dad british passport and my moms and siblings resident cards)
- joint account passbook copies (my mom and I jointly own it)
- joint account passbook copies (my fiancée and I jointly own it)
- wedding hall reservation confirmation email
- wedding invite
- copy of the surprise card I gave her on her birthday tell her we will be going to Canada (she was so excited and was already packing and I still haven’t told her about the refusal )

I will be covering my fiancée expenses so I gave a sponsorship letter and my finances stated above. I specifically stated on this letter that the accommodation approved by my employer can accommodate two people as stated on the bookings so she will not incur any costs for accommodation.

That’s pretty much it. Please help.

Unfortunately, it's not difficult to see why you have been refused. Here are some possible reasons:
1. Your Family Visa to settle in the UK: No idea why you were denied a UK settlement visa if you were under the age of 18 years + if you were not in a partnership/common-law relationship/not married.

Nonetheless, your UK visa refusal history has probably resulted in the Canada TRV refusal.


2. Your personal finances are pretty low and won't cover the cost of airfare for even one person, leave aside being able to pay all the expenses and airfare for your fiancée.


3. It seems the visa officer did not buy the story about your employer gifting you an all-expenses paid vacation to a destination of your choice.

It would probably have made sense if your employer paid for your original visit to Japan which you could not go for because of the difficult phase work-wise.


4. Your employment does not pay well. This is only reiterated by the fact that you are still financially dependent on your parents even though you are employed.


5. Property/land owned by your parents are not reasons for you to return home

Unfortunately, it's not difficult to see why you have been refused. Here are some possible reasons:
1. Your Family Visa to settle in the UK: No idea why you were denied a UK settlement visa if you were under the age of 18 years + if you were not in a partnership/common-law relationship/not married.

Reason was I have gone the wrong way in applying. The solicitor I paid for the first time has directed me in a wrong path for PR. She was taking me along a EEA family settlement procedure which I’m not. Both my dad and I were not involved much and trusted our solicitor with everything and finally got what we deserved for our stupidity. But later we changed solicitors and apprently it was too late because I was over 18. I could have stayed there arguing and appealing but I didn’t want to. So I volunteerily came back. I have got the volunteer departure forms I submitted back when I was in UK in 2016. I can submit them to the TRV application if that can help? Also my parents can sponsor me anytime to the UK where I can stay and not return trying to get some sort of settlement if I’m looking to escape my country of origin. Which I’m not.

I have got personal saving in two different banks which i did not disclose for my previous application because I thought having my employers financial would be enough. These would add upto around 15,000 CAD. Will that be enough for two weeks in Canada?

My employer is aware of my wedding taking place in April 2019 so this was also sort of a pre-wedding gift I suppose and I’m of high importance to them since I secured two client contracts for them which were about to slip from their hands. They gave me the company bank statements which were very healthy and had a monthly cash flow of around 80,000 CAD in one account and around 35-40,000 CAD in the other account. They have another account which they said had a fewer number of transactions so would not be of worth. They gave a letter on the company letter head signed by the general manager saying they will be covering all my expenses for the two weeks. What more proof will the VO need?

4. Your employment does not pay well. This is only reiterated by the fact that you are still financially dependent on your parents even though you are employed.
My basic salary is around 900CAD and with all allowances I’m getting around 1100 CAD every month apart from the vehicle they have given me for my use. This is good money where I am from. I submitted past three payslips on company letter head too. Also my parents send me money not because I’m unable to spend on myself. It’s out of goodwill.

5. Property/land owned by your parents are not reasons for you to return home
All the properties and lands which are owned by parents will be handed over to me in due course. My parents have given a letter in writing to our laywers stating this about a year ago since they have no idea of returing back here for the long run. Also my parents have given the power of attorney to me to handle and do everything that’s including banking and selling or acquiring land. So I’m the person who signs on behalf of my parents legally.

Also isn’t my wedding a major reason for me to return? I have submitted a copy of one of our wedding invites which the VO had returned to me with my passport. Also I submitted an email confirmation from my wedding reception confirming a booking under my name for the said date. Also I have submitted our honeymoon booking for two days. Please help should I reapply?

If you did not declare it then consider yourself super lucky that you have not been banned for 5 years for misrepresentation.

No, your parents cannot sponsor you for a UK Family visa/ Settlement visa. That option does not exist for you.

And showing them all the preparations both me and my fiancée went through for our wedding. I can include the whole wedding binder which my fiancée prepared. Also I can show them everything from the wedding dress order to the honeymoon to the makeup and dressing. Will that be enough? My fiancée will be attending a local uni for her higher studies in September. I can show them the acceptance letter too? Also my family who’s living in England has already booked their air tickets for my wedding and also my uncle and auntie and cousins in Switzerland has also booked theirs too. I can submit copies of those too? Will that be good enough?

Or should I just reapply alone? Because I really don’t want to miss this all expenses paid offer from my employer. If I succeed I can visit and come back on the stated date and then apply again with my fiancée after our wedding? Because I promised my fiancée about Nigara falls so I want to keep my word. And after I come back within two weeks the first time, the VO will be able to trust me on keeping to my word?

IMO, you have a 50:50 chance of a TRV approval even with the new documents.

That said, you would need to explain why you didn't submit statements for your personal bank accounts with your previous application + any regular deposits/transfers from your parents.

Do you have evidence of helping your employer to retain the client contracts?
A letter of appreciation from your employer for your efforts?


1. What might work for your TRV approval is evidence of your wedding. Do you also have evidence of booking the wedding venue, florists, etc?

2. What is not likely to work is your low salary + your employer's financial situation which is not very good contrary to what you might think (business revenue is not equal to 100% disposable profits. Also, your employer hasn't hired just 2-3 people and they don't work from home, right?) + your employer did not offer to pay for your visit to Japan + your visit to Japan itself was for one month (which demonstrates you do not have strong employment ties) + your UK visa refusal history (assuming you declared the refusals and the voluntary departure).

3. What is also tricky to prove and seems somewhat unconvincing is one-too-many vacation gifting in this case. Employer is willing to gift an all-expenses paid holiday to a destination of your choice. You are gifting a holiday to your girlfriend.

Basically, it seems like neither you nor your girlfriend can afford the holiday with your own finances. Hence, each of you is reliant on others to pay for the holiday.


Or should I just reapply alone? Because I really don’t want to miss this all expenses paid offer from my employer. If I succeed I can visit and come back on the stated date and then apply again with my fiancée after our wedding? Because I promised my fiancée about Nigara falls so I want to keep my word. I thought disclosing my personal savings would be uncessary because, my employer has given his financial statements and a letter guaranteeing full expenses coverage with reasons. And also my savings accounts doesn’t have transactions in them. The only transactions are me depositing money into the account every now and then because I never had to dig into my savings so far and I’m saving for the future. So i thought it might look artificial and the VO might think it’s just done for visa purposes. On the other hand I already attached to my previous application bank book copies of my account which I use daily for my day to day needs, it’s where I receive my salary.

And the money that I get from my parents aren’t deposited into a bank account straight away. They send it through a website call WorldRemit and I clear funds from bank using a reference number. I attached those statements to my previous application too.

I already attached a print out of an email from the manager of the venue confirming a booking under my name on my request. As I remember I only added this to my fiancée application bundle. Not mine. Will they be considering both our applications together or should I have had put a copy of it for both bundles? I have every proof of the wedding including florist, dresser for my fiancée, dress sweing for both of us, photographer booking, band booking, etc.

In the fields where I had to state what I have been doing for the past 10 years I stated the 4 years I spent in England from the exact date I entered England to the exact date I left from heathrow. And in the reasons I said I was living with my dad. That its. I didn’t state it anywhere else. Am I in trouble for that? Have I missed something?

I can provide documents about the UK immigration history about what went through and that i did not work or study illegally while my applications were being processed. And I can show my volunary departure form which I emailed. I can get a prinout of the entire email convo with UKBA. Would that help break their first reason for refusal? Travel history?

I sure can afford it with my savings but as I said before I didn’t think it would he necessary to show two sets of financial statements. (Both mine and my employers)

Although it’s true with my fiancée. She is still dependent on her parents as she is not working. She is going to attend a local university for her undergraduate degree. She has received the confirmation of acceptance letter for September 2019. We can attach a copy of it too. Will the VO consider that to be strong tie to return back? Should she attach her parents financial statements too? With a letter of support? Do you think that it might help?

I also am a part of a charity in my country where we provide less fortunate kids with education support. I bear a position in the central committee. I have evidence to prove that too. Will this be a plus point?

I have searched and it seems it will take around 40 days. And I have spoken to my employer and they are willing to cancel my previous approved leave and reallocate leave for me in February. Will the 40 day delay affect the decision. Like will the VO think I took so long to reapply to find fake reasons or anything? Like will the delay affect negatively on our applications?

I sure can afford it with my savings but as I said before I didn’t think it would he necessary to show two sets of financial statements. (Both mine and my employers)

Although it’s true with my fiancée. She is still dependent on her parents as she is not working. She is going to attend a local university for her undergraduate degree. She has received the confirmation of acceptance letter for September 2019. We can attach a copy of it too. Will the VO consider that to be strong tie to return back? Should she attach her parents financial statements too? With a letter of support? Do you think that it might help?

I also am a part of a charity in my country where we provide less fortunate kids with education support. I bear a position in the central committee. I have evidence to prove that too. Will this be a plus point?



I have searched and it seems it will take around 40 days. And I have spoken to my employer and they are willing to cancel my previous approved leave and reallocate leave for me in February. Will the 40 day delay affect the decision. Like will the VO think I took so long to reapply to find fake reasons or anything? Like will the delay affect negatively on our applications?
