Tourist visa for wife of PR

Hi,

I’m a Canadian Permanent Resident and getting married to my fiancé in India in September. After marriage I want her to join me for few months and parallely I would apply for her PR.

I have heard from my friends and read online that it is difficult for fiancé or wife of a PR / Canadian citizen to get a tourist visa. It gets rejected 90% of the time as there is a high risk of them overstaying the visa. Now, I have been suggested the following 3 ways to apply for the Tourist visa:

a) I state the facts in my invitation letter and call her as my fiancé stating that she will come to Canada for her honeymoon and a wedding reception and will leave the county in few months.

or

b) My father sends an invitation letter to her family. Calling her parents and her as family friends (Which we are) without stating that we are getting married.

or

c) She simply applies for the tourist visa without stating anything about me and once she is here we apply for her PR

Which would be the best way to approach the visa aplication to get a tourist visa for her? Any advice would be greatly appreciated.

You cannot lie that she is not married to you.... or call her your fiancee after you are married to her..... this will be misrepresentation and could possibly lead to serious consequences when you apply for her PR

Even if you still go by this route, the visa officer will not accept that she will leave after the wedding reception, etc.... and how would your fiancee visit Canada for a honeymoon without "getting married"?..... so TRV refusal

Will this be after you are married? Again it will be misrepresentation


c) She simply applies for the tourist visa without stating anything about me and once she is here we apply for her PR
I would not try this


The best solution is to be honest.... and ALWAYS follow immigration rules..... do not try to circumvent immigration rules or mislead CIC

I applied for a TRV when I was engaged to a Canadian PR. We got married in Utah, USA before I entered Canada. In the invitation latter thatmy then fiancé (now husband) wrote, he specifically said that we will be married when I enter Canada. I also wrote an explanation letter stating our plans to get married first before entering Canada together. I was granted a multiple entry visa.

Just be honest and provide as much proof as you can that she wont overstay.

Hello Bryanna,

Thanks for the reply. I have no intention of misrepresenting any facts or doing anything that hampers the PR application in the future.

In the first scenario I mentioned, I’ll clearly state that we are getting married on so and so date in September and since the PR process takes 10-14 months I just want her to visit me for a few days.

btw...how does the process work...any PR or canadian citizen who gets married outside canada has to wait for 10-14 months before they can be with their spouse? I've heard its really hard to get spouse tourist visa....

It is possible for a spouse of Canadian PR/citizen to get TRV..... if s/he provides strong reasons not to overstay..... there are success cases

As boopityboo mentioned, she got a MEV after getting married.... she was honest in her visa application about her marriage


When you apply for your wife's TRV, do give true/honest details.... using words like *fiancee* after you're married.... or not disclosing your marriage.... will work against her TRV.... and she must provide strong reasons to return to India

Hello boopityboo and Bryanna.

Thanks for the advice. I will definitely mention about our marriage in the visitor visa application.

Regarding the risk of not overstaying. I plan to focus on the following areas:

1. Work : She has been working with a top indian IT firm for more than 7 years and has got an approved leave letter from her employer.

2. Family : Her parents in India are retired and are dependent on her

3. Financial Background : She has a strong financial background and will be attaching her bank statements, Pay Slips, tax forms, etc.

4. Previous Travel History: She has been to UK before on a 1 year work assignment.

5. Return Flight tickets, travel itinerary and trip budget

Is there anything else we can attach which can strengthen our case?

Hi,

Her ties to India are excellent.... it will help her to get the TRV


Some other points that I can think of:
a. Does she own any property? Or is she a nominee/POA/Representative for property owned by her parents?

b. Can she provide a *must return by date* for example, project completion, an on-site client visit, family event, etc?


My advice is take the time and prepare a good application.... provide explanations backed by evidence for each of the areas you have mentioned

Thanks for the pointers.

Should I also mention in the application that we plan to apply for her PR after marriage and would never do anything to jeopardize the PR application by over staying on the Tourist Visa?

In your first post you had mentioned that you want her to visit after your marriage in September.... are you applying for her TRV now?

Hi Bryanna,

My first post was not that clear.

We are applying for the TRV now. In the TRV I will mention that we are getting married in September and she will visit me after marriage for few days.

Meanwhile, I will also submit an outland PR application for her after marriage (Sometime in late September)

I dont know if people would advice it but that worked for me. I wrote in my cover letter/explanation letter that we are applying for PR and would not jeopardize it by overstaying.

I guess they already kind of expect that, so for me, it wouldn't hurt to mention it. It shows that you know the legal process of living permanently in Canada.
