Hi,

I am struggling with my TRV application for my mother. My father passed away recently so not all bank accounts have been transferred to my mother's name.
  • As proof of funds, I am showing my brother's bank statement and IT returns from India + my pay stubs and 6 month bank statement showing upwards of $50k in Canada.
  • A support letter from my brother stating that my mother lives with him in Pune for a few months and at her home in Delhi for a few months. He takes care of her daily financial needs.
  • My mother's real estate asset documents - 2 condos in India
  • I am showing her return flight ticket to India
  • I am stating in my invitation letter that she will stay with me and I will be responsible for her financially and otherwise
Questions:
  • Do I still need to show my mother's bank statements? She does not have sufficient funds in them - $1,000
Will the above be enough to show her strong roots in India and her financial status?

If your mom is the nominee in the bank records, she can have the accounts/funds transferred to her name. Or else through inheritance laws.

Your brother must include a letter of financial support too.

Your brother may also want to consider buying Forex cards in your mom's name + include the receipts for the purchase.

Letters and explanations won't work without hard evidence.

Also, if your mom has access to your dad's finances + is able to live in Delhi on her own.... then she isn't exactly a dependent on your brother.

Technically, India does not have 'condos' as such. You would want to use the correct term for your mom's application.

You would also want to include valuation of these apartments (either self or by a CA) backed by other evidence to confirm that the valuation matches the indicative market value + ownership documents + maintenance receipts + property tax receipts, etc.

Don't book any tickets until a TRV is granted.

Does she file tax returns?
Does she have other financial investments?
Does she get a pension?
Any rent?

IMHO, she does not have a strong application + no active ties to return to India. Also, unfortunately, as your dad has passed away recently (no family ties), it would seem like she is moving long-term to be with you.

Hope her visit is for max 3-4 weeks + she is able to demonstrate active ties to return to

Last year I applied for US visa for my mother, my mother-in-law and my mother-in-law's sister ( one after another) and all 3 got US visas. We didn't show any proof of ties to India. All I showed was $25k USD in my US bank account.

My name is <name> (DOB) and I am the eldest child and son of <mother's name>. I am writing to you with reference to my mother’s visitor visa application to visit my younger sister, <my name>, in Canada.

This letter is to state that my mother lives with me at the above-mentioned address in Pune, India few months in a year and the rest of the months at her home in Delhi (Delhi address). She is dependent on me for daily financial needs in India. As assets, she co-owns a flat with me in Pune, India and is the owner of a recently purchased flat in Greater Noida, India.

She has strong roots in India including her immediate family - my wife, myself, our two children, her mother and brother and his family.

During her stay in Canada, my sister will take her sole responsibility, financially and otherwise. Needless to say, my mother will be returning to India after her visit.

Enclosed with this letter, please find the following supporting documents:
  • My passport copy
  • My bank account statement for the past 6 months
  • My Income tax returns for the past three years
  • Possession papers showing joint ownership of flat in Pune, India
  • Booking agreement of flat purchase in Greater Noida, India
is this letter okay to show financial support?

- as a senior citizen, she has no income so does not need to file any IT returns.
Does she have other financial investments?
- her savings are in stocks and shares but only 'market value' can be shown and not an actual statement.

IMHO, she does not have a strong application + no active ties to return to India.
- I am not going to state that my father recently passed away anywhere in my application. I don't want to raise any doubts about her profile. Her son and his family, her own mother and brother are in India - are those not considered as active ties?

- I am hoping to get her to visit me for less than 6 months as allowed in a TRV

That's what is my concern too. All the requirements seem too unnerving!

US and Canada are two different countries. The visa assessment processes are completely different. Each case is unique too. So, it's not a one-size-fits-all kind of visa paperwork.

And, sometimes applicants can get plain lucky even if they don't actually make the visa cut!

This forum only helps someone to understand their visa application risks and how to minimize those risks.

One always has the option to pay for immigration advice off this forum + to submit their applications with the bare minimum of documents/evidence if they are adventurous/willing to risk refusals!

What works for someone else may not work for your mom
true. I have heard many examples of visa rejections despite heavy documentation. so now sure what works. Which is why looking for avenues that are doable yet answers all their concerns.

If your sister is a PR and meets LICO, you would want to consider applying for a super visa instead.


Also, your previous post has a number of incorrect assertions + statements.

For example:
Senior citizens are NOT exempt from filing tax returns in India even if their income is below the taxable limits.

Also, to ensure your mom is not investigated by the tax authorities in the future, you would want to file her tax returns every year especially as she owns property + she needs to account for the funds used to purchase those properties

I too have same feeling.. even that $25k is not mandatory document requirement. If one has their son or daughter in US with valid work permit, and if the parents speak confidently during interview, that's all it takes to get US tourist visa. US Visa is one of the most sought after visas in the world. I know tons of parents who have absolutely no income, property or any kind of ties easily getting visas without any issues.

I see few such cases getting Canadian visa too, like no proper ties, no filed income, but got Canadian TRVs, but experiences in this sub forum seem to suggest otherwise.

I am collating the following documents for my mother's TRV application. Kindly let me know if this is sufficient or some items are unnecessary:

1. Mother's Bank statements (6 months)

2. Mother's investment account statement (6 months)

3. FD certificate

4. 2 property ownership papers

5. Notarized CA Letter declaring mother's networth (Is notarization required?)

6. Mother's passport

7. Mother's old passport to show travel history to Europe (2005 and 2006)

8. Letter of Explanation from Mother

9. Mother’s digital photo

10. My husband and my NOAs for 2 years

11. Our Canadian bank account statement for 6 months

12. My husband and my PR Cards

13. Our Passports

14. Our pay stubs (should we provide 6 months?)

15.My invitation letter with itinerary

16. Return flight tickets (The checklist provided by CIC asked for this so not sure what to do)

17. Brother’s letter to reaffirm my mother's family ties to India

I am showing that my mother will visit me for 2 weeks.

Should we also buy medical insurance as indicated in Document Checklist (IMM 5484)?

My mother is not liable to file for ITR in India as she is below the taxable income (senior citizen + woman + interest/dividends are much below the annual taxable income). She does not receive any rent or pension. Purchase of new house will be shown in next year's ITR. So, to date she does not have ITRs to show.
