Hi ,
I am full time 2 year program international(Indian)student in Centennial College. My wife (Russian) applied for study visa on 20th Jan 2013 but got refusal. In the visa application she didn't mention our marriage status because till that time we didn't get our marriage certificates . We got married on 24th Dec 2012. Now we have got marriage certificates and are confused whether to apply for spouse visa or study visa. Will there be any problem because before she didn't mention marriage status in study visa form?? We love each other a lot and want to live together , I feel difficulty in concentrating on my studies too because she is far. Please help us.
Regards
AJAY

She can apply for an open work permit based on your study permit or she can apply for a study permit again if she wants to study but if she was denied already, she needs to show more proof that she will return home at the end of her stay. The most common reason to be denied a temporary visa is risk of overstay.

Leon -

I don't think re-applying will work in this case. His wife committed misrepresentation in her first study permit application by stating she was single when she was in fact married. If she applies again with the marriage certificate - at a minimum, I think CIC will refused the application given she lied about her status in her first application. Worst case scenario they might make a finding of misrepresentation and ban her from entering Canada for two years.

I think that our Government has caught on with the sudden influx of marriages. I know of a family that provides a marriage every two years to bring someone here from India. They were investigated already but haven't been caught yet. I don't envy Imm officer's jobs. Everyone they meet will lie to them at some point or another.

This sounds like a nonsense. The government can't keep track of their name for 2 years? If so, then they know they applied before.

It's obvious you don't know too many immigrants. My friend is Punjabi. All their names are "Balvir" and "Singh". It's like our Smith and Jones. Try to keep those straight.

You may wish to talk to your friends again. Sikh males have the name Singh (Lion) and females Kaur (Princess) Some only go with a first name and either Singh or Kaur. Others will use a Goptke as a surname.
