Who is the family member in relation to you? The answer is very important.

I assume you are either a PR or Canadian citizen?
 
Hey, My husband is South African, he is doing Ph. D in Canda, and will get a PR in serveral month.

Before he arrived Canada, we registered marriage in South Africa long time ago. We are gay couple. and he knows my HIV+ status.

He will sponsor me.

If he has applied for PR, then he MUST include you in his application as a dependent since you are married. If he did not include you in his PR application, he MUST contact CIC NOW to let them know he is married and to add you to the application. Both of you must go through a medical and pass the medical in order for PR to be approved. Since you are HIV+, it's quite possible CIC may determine that your health condition will place a burden on the Canadian health care system and inform you that they intend to deny the application. If this happens, you will receive a "fairness" letter and will have the opportunity to respond to that letter and convince CIC that your condition will not pose a burden. I would recommend that you search for the word "fairness" and "HIV" on this forum so that you can learn more about this process and what you can expect. Note that if you are refused PR due to your condition - your husband will be refused as well. Both of you have to successfully pass the medical. Good luck.
 
It is VERY IMPORTANT to listen to scylla's advice and make sure CIC/IRCC knows about your marriage ASAP and definitely before he becomes PR. If you are not listed if he becomes a PR, then he committed misrepresentation (this a crime) and you can never be sponsored by him ever. This is extremely serious.

Hey, thanks for your suggestion. When he applied study visa, he include me in the family member infor. I also have a visiting visa to vist him, when i filled in family info form, i indicated he is my husband

So I dont think this is a problem

Thanks very much for the infomation, Well he is not HIV positive, only I am, he never care about me. If i didnt past, will he fail?

Has he already applied for PR?

Including you in the family information form of a study permit app is a far cry from being included in his PR app. You need to complete the medical, obtain the necessary PCCs and documents and fill out the forms.

Yes he MUST be included in his husbands PR app for sure (either as accompanying or non-accompanying) or he can never be sponsored by him ever.

I think I've read on here that HIV+ people nowadays generally ARE deemed admissible, but it may depend on the amount and cost of medications required. Don't know much on that topic though. Do some searching through the forums and the google.
 
Just to add: you must be included on his application for a PR as his spouse. Just being listed on his application for a study permit and for a visitor visa is not enough.

People can be approved even though they are HIV+. It will depend on your medical.
 
Hi i need a help! Im already a permanent residence and three years living in canada so i could process my paper for my citizenship,

But my question is” i have a boyfriend from the Philippines we’re both gay. And he is HIV + i got a mail that yes i could sponsor him. But we’re not yet married i read some article also that i could do is sponsor him for tourist VISA and get married here. How about to process our spousal? Do we need some lawyer for this cases? I don’t really know what to do. Can someone help please. And thank you..
