Hi everyone,

Below is my situation and I was wondering if anyone can be of help.

I got my PR in August 2018 and did my landing later that year - Nov. 2018 but since then I have not entered Canada because of certain personal/family constraints. I have been in the UK since then and now married with a kid. My PR card expires later this year and I know I have not met the residency obligations for a card renewal.

I intend to re-apply for a new PR, this time with my family. I read online that I would need to renounce my PR before applying for a new one. However, I have some questions and would need some clarifications before going ahead with voluntarily renouncing my PR status:

1. Will renouncing my PR have any negative impact on the new PR application?

2. Is there a way to appeal my inability to meet the residency obligations in order for my PR card to be renewed from outside Canada?

3. Are there any other routes I can explore to come to Canada with my family before my PR card expires in Dec. '23?

I would love to hear from everyone especially people who have had the same experience or are currently in the same situation.

2) Cannot renew PR card from outside Canada
3) Assume your family has UK passport, they can try to apply for a ETA and you can use your existing PR card
4) Your case is very common and you should be able to dig further.

If you mean to just visit, they just need eta or visa.

If you mean to reside: the problem is that while you could possibly return without renouncing and re-applying, you would be out of compliance and it is not recommended/problematic to sponsor your family members while out of compliance. And it would take two years for them to get in compliance. In the menatime, they would not be able to work, and health care and schooling may be more or less difficult (but you should assume health insurance not possible / problematic in most but possibly not all provinces).

Other options would be things like you renouncing and getting a temporary work permit or other but those are all basically starting from scratch.

Di you have proof of H&C reasons that prevented you from moving from August 2018? For example proof that your parent had terminal cancer and they very recently passed away? You would need proof treatment, hospital records, proof that your presence was needed throughout the whole illness time for example being the only child in the UK. How much time did you spend in Canada after you landed? The big issue is that you landed long time ago and also went on to get married and have a child so your life wasn’t on hold. If you did feel like you had H&C reasons you could try and apply for a PRTD based on H&C but that could take 6+ months with no guarantee of approval. You would still have to sponsor your family so no access to healthcare or schooling (depending on the province and school district) until getting PR. If you qualify your best option is likely to reapply for PR so you can all arrive in Canada with PR.

2. Yes but you would need compelling reasons and you have to be honest with yourself about whether they are convincing, because otherwise it's just prolonging a decision you already know is coming.

3. You can enter with your pr card, see what happens when you get to the airport, whether you get reported or not. If you're somehow lucky, you won't be reported and then you can stay in Canada until you meet the residency obligations. Note you won't be able to leave otherwise you'll face triggering another report when you re-enter. You would have to be prepared for questions from the immigration officer on why you didn't meet your residency obligations.
Other than that, it's just mainly through express entry like everyone else.

Don't worry, my son was in same situation, his card was going to expire in 4 months, he just walked in..No questions asked as long as your pr not expired.. Don't renounce it.. Apply visit visa for your kid. Then once in country apply for her.

That isn’t the case. People do get reported with a valid PR card. The chances are lower than without a valid PR card but people do get reported when they still have a valid PR card. Many also get a strong warning with a note on their file but are not reported. If they leave a second time their chances of being reported are much higher.

I would say the real issue is whether he can sponsor his family members straightaway, and if not, whether waiting is manageable for them.
