Hello!

I'm a foreign live-in caregiver based in Ontario who is about to complete the 24-month period required for PR application by July 2011. I was informed that the processing times nowadays will take 10-11months for step 1 approval, and another 15months for the final approval. The thing is, I have a fiance back in my home country and we originally planned to get married AFTER I received my PR, then I will sponsor him to Canada. However, since the processing times tend to get longer as days pass, I don't think I can wait that long. My other option is we'll get married prior to July 2011. Will that be ok since I'm assuming that in that way, I can already include him in my PR application.

Thanks!

Please note that the times you have mentioned are for Applications Processed Within Canada(a.k.a Inland Applications).
You also have the option of Applying Outland which depending on where you are from the waiting time may be shorter in comparison to Inland Applications.

So, for you to apply INLAND, you both have to be IN CANADA.

If he's staying in his home country you won't be eligible to apply within Canada.

You will have to fill an OUTLAND application.

I'm getting confused. ;D My situation is I'm a foreign caregiver who will be eligible for PR application by July 2010. I believe that by the time a foreign livein caregiver applied for PR, the applicant can already include dependents such as spouse/children in her application and sponsor them at the same time in coming to Canada, right? My problem is I have a fiance back in my country (Philippines), which doesn't fall in the family members category. My question is should I apply for my PR first then once I get it (which may take up to 2yrs), I'll sponsor him to Canada...or, should I go home and marry him, and then file my PR application so I can already include him in it?

Living caregiver PR apps are always filed as inland. When they are ready to process her partner's part of the application, it will obviously be outland since he's not in Canada. It's basically the same thing as filing an inland spousal who has dependents overseas. The principal applicant's part is processed in Vegreville and the dependent's is processed outland. The application itself is still submitted to Vegreville. OP, I think if you can, you should get married first and then the whole PR application processed in one go.

Yup, that's what I thought. But is it true that you can't get your PR if your dependents PR application has been denied?

I think that may be the case if the dependent is found inadmissible (criminal, medical etc). I am going to look some more into it. There is also a live in caregiver thread here in family sponsorship part of this and they may have more experience/info.

Sorry, it wasn't my intention whatsoever to confuse you, however as you hadn't given any background information I ended up not giving the answer you expected, I am sorry! :)
Hope the replies above helped you somehow.

It's ok :) I'm just seeking advice that may help me decide whether I should marry my fiance prior to my PR application or just wait for my PR first before I marry him :)
