To Marry Before Landing or after Landing

Hello Friends,

My name is Aditya. I am from India and in India currently.

I have been reading all posts about 'getting married before landing' however not got the case like me. If you can answer my situation it would be really greatest help as I have not got yet the reply to the same question which I have sent to CIC.

Situation :
I have received PR Visa and COPR having expiry date of 15th november 2014.I have already booked flight for first week of nov. 2014

1) I might get married in the month of September 2014 in India. In this case, can I sponsor my wife before leaving to Canada ?
OR
2) Should I have to travel Canada first then come back to India and marry , then sponsor her and go back to Canada?
OR
3) I can call my fiance to Canada , get married in Canada and apply from within Canada for sponsorship ?

Can you please explain me all these scenarios that which one would be faster or easier because according to that I need to take decision? Also which one is faster inland or outland ?

Note : I have asked my agent regarding the same and he told it is bad idea to return COPR as nowadays visas are taking much longer time however they are telling me that as my file is closed I can marry , start wife's process from India itself and go to Canada.

I suggest you do your landing in Canada first (while you are still single) and then come back to India to marry or return the COPR to the visa office and explain that you would be married in September. Otherwise, you might not be able to sponsor your wife and jeopardize your own PR status.

1) Please let me know that after coming back to India , where from I have to apply? Do I have to intend visa officers again at the second time entry with PR card that I am married. (not sure on the PR card is it written single or married and if they ask I am married and in the PR card it will be single)
2) Second If I return COPR don't know how much time it will take !!

As a PR, you will need to be in Canada in order to sponsor your spouse. Where is your visa office?

In any case, you would need to check with New Delhi visa office about the processing time for a new COPR.

The 'quickest' easiest route based on the 3 you have listed here would be for you to get married BEFORE you land. As SOON as you are married, contact your VO and alert them to this fact. Tell them you would like to return your current visa and add your new wife to your application. She would then need to fill out the appropriate forms, have police checks and get her medical clearance, much the same as you did, but once she is issued her visa you can BOTH come to Canada at the same time.

IF you land as single and then return to India and marry you would then need to return to Canada to sponsor your new wife as you can not remain in India with her. As a PR you MUST remain in Canada to start the PR sponsorship and until the day she lands. Short trips are OK but many suggest you should not leave for more than a couple weeks at a time otherwise you risk having your new application rejected.

If you opt to do the single landing then return to marry, the odds of your wife being issued a visa to visit Canada are going to shrink dramatically. You and she would have to overcome the strength of the bond of marriage to prove she would return at the end of her visit. IF she were able to obtain a travel document and come to Canada BEFORE you are married, but after you land, you COULD submit an Inland application for her sponsorship, however, she must be prepared to NOT LEAVE CANADA for a minimum of 18 - 24 months. She would not be able to work for that time frame, nor study or anything else that a Canadian Citizen or a PR could enjoy. Do you feel she would be willing to forgo her family for roughly 2 years with no contact with them other than if they are able to come to Canada or phone/email/skype type of contact. If you even remotely think she would not be happy with that route, then do NOT apply for INLAND sponsorship because she can NOT leave the country while it is being processed. If she does this and can not return for ANY reason the application is considered abandoned, your fees would not be returned, you have no chance of appeal and you would need to begin again with a fresh OUTLAND application. I think Delhi is currently around 32 months or so to process a spousal sponsorship application.

Much information to digest, I know, but honestly, your single best bet if you are sure you wish to marry soon, would be to forgo your current visa and add your new spouse. It will be easier and faster on you both.

They would have to marry immediately upon arrival in Canada and he would then need to send her sponsorship papers immediately after the marriage. If he were to do that, they may look a lot more closely at his application since his new 'wife' came to Canada with him as a single woman, he landed as a single man and they just happened to get married within a few days/weeks of that point in time? I think it would cause a great deal of problems for CIC as they may feel he was in a common law relationship or something similar with this woman before he landed in Canada. Why would anyone put themselves into a position where their application would/could be scrutinized quite closely for something that is completely avoidable?

Again, even if they were to go this route, he would need to sponsor her INLAND and he would again need to answer the question, is his new wife ready to be separated from the rest of her family for 18-24 months without seeing them? If he decided to let her go back to India and sponsor her OUTLAND are they ready to be apart for up to 32 months?

This is in response to your recent email enquiry to the Immigration Section of the High Commission of Canada in New Delhi.

If you land in Canada and then get married, you will need to sponsor your wife from within Canada. For information on sponsoring family members, please visit the following website: . However, if you get married first , please do not travel on the given visa.

If you or a family member have modified personal information after the issuance of a visa, including if you have obtained a new passport, you must request that a new visa and Confirmation of Permanent Residence (COPR) be issued. This includes if you have married or have a newborn child who was not included on your application at visa issuance.

If you do not request to include your spouse or child(ren) on your application BEFORE you land in Canada, you WILL NOT be able to sponsor them to Canada in the future. The newly added family member must meet the requirements and undergo medical and background examinations EVEN IF they are not accompanying the principal applicant to Canada.

If you applied under the Family Class, you must have a new spouse or child added to both the sponsorship in Canada (and pay the processing fee to the Case Processing Centre in Mississauga) and to the permanent resident application being processed at the visa office overseas. In order to add a new dependant to a sponsorship, the sponsor must call in Canada 1-800-242-2210 and ask for the appropriate forms and instructions:

Do not attempt to travel on your visa and COPR until the modifications have been made or you may not be permitted entry at the Port of Entry in Canada.

You are required to submit:
- any documentary evidence of the modification;
- the original passports with visas for yourself (and all dependants);
- the Confirmation of Permanent Residence forms for yourself (and dependants);
- an updated or new passport with the new information for those people with modified information; and
- a processing fee of $30 CAD for re-issuance of previously issued visas for each family member
- Passport size photographs for yourself and each dependant

If you are adding a spouse or newborn child to your application, you will also be required to submit the following documents:

- a letter explaining how your family composition has changed and requesting that your spouse and/or child to be added to your application
- updated IMM0008 Generic Application Form and updated IMM5406 “Additional Family Information” form for yourself to include your spouse and/or child

- A completed Schedule A Background Declaration form, and an IMM5406 “Additional Family Information” form completed and signed by your spouse
- If the spouse or child is accompanying you to Canada, processing fee for your spouse and/or other dependant
- notarized copy of the birth certificate of your spouse and/or child

- copies of experience and educational documents for your spouse
- copy of your spouse’s and/or child's valid passport (s) both valid and expired
- four recent passport-size photographs of your spouse and/or child according to the specifications
- a copy of your marriage certificate and marriage registration
- a few marriage photographs depicting pre and post wedding and also of the ceremony itself.
- police clearance certificates for any country in which your spouse has resided in for 6 months or more since turning 18 (see for more information)
- the Right of Permanent Residence Fee will need to be paid before a visa can be issued to your spouse (if accompanying you to Canada)
- you must return the passports and visas for persons where visas have been issued in order for us to proceed with processing your added dependants

- two additional recent passport-size photographs for each person with previously issued visas that must be cancelled, according to specifications

- if you applied as a Skilled worker - updated proof of funds for number of family members to now include added spouse and/or child

- a “Certificat de Sélection du Québec” for your spouse or child ( in his or her name), if you wish to immigrate to the province of Québec

Upon receipt of your request for visa re-issuance and the above mentioned documents and fees, our office will re-issue visas with the modified information. Please note that new visas may be issued for every family member, not just those with modified information, therefore it is important to submit all the passports and COPR’s for everyone included on the application.


Our office generally requires one week to process requests for visa re-issuance. However, if you are adding an additional family member then the processing time will take longer as the added family member will need to be examined and meet the requirements for immigration to Canada.

1) If suppose I land in Canada and marry as per you so can I marry in Canada or in India after coming back to India as per you?
2) If I go to Canada and return after 3-4 months, after taking PR card , marry in India , Can not I apply from India for my wife , how much time does this process will take ?
3) If I return COPR and VISA with passport how much time will that process take , If I do not fly ?

Please do not provide me the link of processing time for New Delhi office. Instead please let me know in the mail itself.

What do you want to know exactly?

Nobody can give you exact timelines.

I think I pretty well outlined what their response was in my initial response to you. I gave you the options and how they would 'play' out. How you would need to work within the guidelines to complete the process.

As I said before, there is NOBODY who will give you exact timelines as to how long this will take no matter which route you take. The only thing I can tell you, is that in order to minimize time spent apart your BEST bet is to marry and get her added to your current application before you land. Historically speaking, that is the fastest route for both of you to be together in Canada.

Alurra is 100% correct...your only and easiest bet is to marry ASAP, return your visa and add your wife on your application by submitting the docs as mentioned in NDVO mail..then complete your wife' medical... submit her passport and wait for her visa...it may take 2-4 months after the submission of docs.

why do you want to go for hard way of sponsorship when you have an easy option?you don't break a wall when there is a door available for entry....follow the mail you have just pasted.....it has everything you want to know....

hai all
i am from India and still in India. i got my visa but i got married before landing and my consultant told me i have to send my spouse documents and have to add her before landing. i submitted all the required documents on June 2014. how long i have to wait for new visa? when i checked in website with my old file number it doesn't show anything. why is it like that?
please someone help me... am tensed about it....

You will have to wait until they have fully examined your wife both medically and criminally before your new visa is issued to both you and your spouse. If you try to do it any other way you are only going to cause yourself a heap of heartache later on. Just try to be patient, it will work out as it is supposed to.

Thanks Alurra.. for your reply. i am not going to try any other way as i never do anything in shortcut method. i already submitted all the documents. now am waiting for my new visa.hope it ill come soon.can u tell me how much time it usually takes to issue new visa in cases like mine? is it 3 to 4 months?
