To delete the spouse of not?

Here's the situation. (I've not found the answer on CIC or searching old threads.)

Is the question of family relationship in regards to a significant other determined by your country of citizenship or country of residence?
My common-law spouse is included in my application as not accompanying me as we're both already in Canada.
However, CIC even after submitting proof that she's a Canadian citizen requires her information, travel history, family, etc., including a UCI.

My thoughts are to delete her from my application but I have concerns because a separate Canadian government agency has us listed as common-law partners in Canada.

So, do I delete the spouse or try to get CIC to answer me about having her included in the application period?

Be truthful to the system. I know its a lot of hassle to fill all those details, but its one time pain.. go for it. Its worth. If you delete ur spouse, you might land up in "a case of misinterpretation"

Dependents who are already Canadian citizens/PRs are NOT included in PR apps.

Thanks for the replies everyone. I completely agree about being truthful, so I apologize if it came across as otherwise.
I meant to say more along the lines that my country of citizenship does not classify my family as common-law, but Canada does, and since I've been in Canada for so long that I initially claimed common-law.

I'm applying under CEC due to my Canadian education and work experience and have been accepted as such. I also know she's not included in my app, but there is an entire section requiring spouses information, hence my question.

I will contact CIC first thing tomorrow and update with any info. Thanks again everyone!

It doesn't matter that your country of citizenship doesn't recognize common-law. You are applying for Canada, therefore Canada's rules apply.

You have to include your spouse because no matter he/she comes with you or not, he/she can definitely get Canada immigration residence if you, after being a Canadian resident, apply for her. Therefore, she will need to do her medical during your immigration process, no matter she comes with you or not. If she does not pass the medical, your application will be affected regardless of whether she comes or not.

Believe it or not, I just spoke with CIC who said this is an error in their system they're aware of but that I should still continue the application noting a non-accompanying spouse who is a Canadian citizen.

So the real answer is:

If you're married or common-law with a Canadian citizen who is already in Canada, you MUST specify that yes, you are married or common-law on your family status, indicate the spouse's country of residence & citizenship with passport #, etc. and to leave certain boxes, i.e. UCI blank. This will raise an error flag, but upon reviewing the info., an immigration officer will clear the error manually and proceed with the application.

So much headache just due to bad operating system programming.
