To Canada to work with my italian own company for a canadian company

Good morning..... I'm new and i want compliment with all for the forum..... great idea....

I'll try to read all in the forum but i don't find a specify replay to my questions. I hope that this is the right topic.

I'm an italian arborist and i want move to Canada with my family. I've already a company that want hire me and have start all practice for sponsor me..... The time are long and meanwhile i'm waiting i've thought to try this way with the owner of canadian company. We can do an agreement with the our company that i'll work for his company for example for 6 month writing good all specific..... money refund and all what need specify.....

Is possible or not? Or can i come in Canada and open my own company and after work for the company that want hire me? In this way can i have the canadian residence?

Basically, you want to cheat the system and bypass the normal procedures?
I think that the answer is going to be "no" and you might get into a lot more trouble than it's worth.

No, no........ not for bypass the normal procedures..... i'll think to leave Italy for all the peaple that bypass normal procedures...... and i want go in a country that the rules works in the same mode for all citizen........

Sorry i'm italian and probably i explain bad..... only for work meanwhile i wait the work permit.... i pay my regular taxes in Italy for the work i'll do for the canadian company.... i'll do regular receipt for the company that pay me for the work i'll do......

The other solution, about i've asked information, is to have my company in Canada and if i can have the canadian residence is only for know if i'll must do an special health insurance if i'll don't have the residence and don't having the residence sure i'll can't have health assistance and i'll must pay all the fee.....

This second solution is only if the work permit don't arrive, for have a chance more for remain in Canada.......

It's a bit difficult to understand what you are asking.

If you want to work in Canada you must first find an employer who is willing to offer you a job. That employer must then obtain an approved Labour Market Opinion. As part of this process, the employer will have to advertise the job to prove that no Canadian could be found to be hired - and will also have to pay a fee of a few hundred dollars. If the LMO is approved (not all are), you can then apply for a work permit.

So if you have already found an employer, as a next step, that employer must get an approved Labour Market Opinion.

Ok, the employer have already do all the paper and to the 27 august finish the last advertise done..... to this advertise, as already do 2 times ago, nobody replay... is a superskilled work....... climbing certificate arborist ISA...... i hope this is the last done.....

After reading next step. If the LMO approved i can apply for the work permit..... And, usually from the finish of advertises, if all the things are good, how much time need for have the approvation from the LMO and after the approbation, i'll do the apply for the work permit.... how much time need for have the paper and start to work to Canada?

All this questions, only for understund about in wich range of time the thing can go..... Know i'll came to Italy and I'll must sell my house and thing for after came to Canada but i wish know about how much time need from the apply for the work permit to have all paper ready for work.....

A range..... i don't know..... from 2 month to 4 month for example......

After if the things are too much long, meanwhile the paper go on, i've thought that maybe that i can came to work to canada like foreign company but with a regular agreement with the company for that i'll go to work..... naturally, doing regular invoice (all the money for the work naturally are specify in the agreement)...... This like plan B if the paper need for example 1 year..... after if came the work permit i close my italian company and start to work like employ......... but this is the plan B..... but this is another that i have thought to do only for avoid to rent an appartment for long time and start earlier possible for Canada......

However it is taking longer than usual to process work permits due to the strike.

I would not sell your house until your work permit is approved since there is no guarantee your work permit will be approved.

Unfortunately I don't understand your other questions.

Thank you for the replay.... i've looked the link and i want ask a things..... is possible that need 21 month if i apply in Rome (Italy) and 15 month if apply in Ottawa...... change a little but the time of process are very long..... i've thought 5-6 month for the approvation of LMO and after all was done.... only 2 or 3 month for have the work permit...... I've realized right? about 2 year for start to work in Canada? I hope to have realized bad........

For the other question, nothing.... sure i explain bad...... but tomorrow morning i'll go to the BC PNP for have more information of the business.....

I still think that you will have to apply for a work permit regardless of how you try to arrange things. It does not matter if you work for a "company" in Canada or Italy, YOU still need formal authority to work as a "temporary foreign worker".

If you are trying to gain Permanent Residence through employment, I believe that you will have to apply as an FSW with "arranged employment". PNP options may also be available.

I don't believe that the option of "self employed", "startup company" or "entrepreneur" are available at the moment.

Italy (Rome) is currently 2 months for work permit processing (excluding the strike delay). This is for temporary foreign workers, not permanent residence.

Ok, now i've the information about the British Columbia Provincial Nominee Programm......

The British Columbia Provincial Nominee Program (BC PNP) accelerates the Permanent Resident application process for skilled and/or experienced workers, experienced business persons and their family members who want to settle in BC permanently. It allows nominees to apply for Permanent Resident status through Citizenship and Immigration Canada (CIC) under the fast-tracked Provincial Nominee stream – which can be faster than applying through many federal immigration streams.

The Strategic Occupations component of the Provincial Nominee Program helps BC employers recruit or retain qualified foreign workers to help meet current and future labour needs. Nominee applicants under the Strategic Occupations component must either have a job offer of indeterminate length from a BC employer or have completed a masters or doctorate degree at a BC post-secondary institution in either the natural, applied or health sciences.

For applications where a job offer is required, the employer and the nominee applicant (potential employee) submit a joint application to the BC PNP. The need to employ foreign workers in an occupation is assessed based upon current and projected labour market conditions and economic benefit to the province.

The Strategic Occupations component has five areas of focus:

skilled workers
recent international graduates from eligible Canadian post-secondary institutions
recent masters and doctorate graduates from a BC post-secondary institution in the natural, applied or health sciences (for this category only no job offer is required)
designated health professionals
entry-level or semi-skilled workers in select occupations

I'm in one of this catergory but the other problem is that the private employer must meet some requirement:

The employer must be incorporated or extra-provincially registered or registered as a limited liability partnership in BC
The employer must have a permanent establishment in BC (“permanent establishment” has the meaning contained in the federal Income Tax Act). If applying under the Northeast Pilot Project, the principal location of employment must be within the Northeast Development Region of BC
The employer must have been in operation in BC for at least one year (two years for the Entry Level and Semi-Skilled category); and
Businesses located within the Metro Vancouver area must have at least five permanent, full-time employees (or full-time equivalents) in BC at the time the application is made to the BC PNP;
Businesses located outside of the Metro Vancouver area must have at least three permanent full-time employees (or full-time equivalents) in BC at the time the application is made to the BC PNP.
The BC PNP may consider applications that do not meet these minimum requirements if an employer has substantial business operations outside of BC or can present a compelling business case.
The employer’s business must be financially sound and have a history of good workplace and business practices, including compliance with all applicable employment, labour, immigration, health, and safety laws and regulations.
If the nominee applicant has an ownership stake in the employer’s company, the share must be less than 10%. Individuals who own 10% or more are not eligible under the Strategic Occupations component of the BC PNP.
The BC PNP does not accept applications from:
Employers involved in the production, distribution, or sale of pornographic or sexually-explicit products, or in the provision of sexually-oriented entertainment or services.
Employment agencies and similar placement firms unless they are establishing an employer/employee relationship with the applicant.

Employers may be required to provide information confirming that they meet the above requirements. Employers supporting Entry Level and Semi-Skilled applications will be required to sign a declaration regarding employment, immigration, health, and safety laws and regulations.

After the wege must respect some requirements in base of the number of components of the family..... so must be enough for live.....
