Hi Everyone, I got married in February, 2006 in India. We lived together till May 2011 in India. Then we immigrated to Canada as skilled worker in May 2011. I was the principal applicant. Since May 2011, we were separated, as we both came to Canada on different dates and never met after that date. After six months I went to India i.e. in Dec, 2011. In August, 2013 I filed for divorce in an Indian court on the ground of separation. In September, 2013 I started living with my girlfriend and she got pregnant. Indian law was very complicated and I could and get divorce there. In March, 2014 I landed in Canada in the same province where my previous wife was living. I filed divorce in Canada and got divorce in July, 2014. Now my girlfriend gave birth to a baby girl in August, 2014 and she is still in India. Now I want to bring both my girlfriend and her baby to Canada because I had married her in a temple (not legally in court because my divorce was not final at that time) in September, 2013 and I love her. She is my wife. Now my problem is that we have a baby but we are not married yet in papers. I am going to India in September, 2014 to register our marriage in the papers. What I will say to Canadian visa officers that how baby born before marriage. My question is that will Canadian officers allow me that I could live with my girlfriend before I get the divorce. Will they consider my baby legal? I want to bring her to Canada along with her mother. What will happen now? Please suggest me something that how can I bring my wife and daughter to Canada.

You don't need to be legally married to have a baby with someone. You will be able to sponsor your partner and baby.
 
Thanks tink23..But will canadian officers not consider that i lived illegally with my girlfriend while I was not divorcee? Can I live with someone else when I am separated from my wife.?

Yes. This is Canada. We are very open and free.
 
Once you get a legal divorce from your wife, and marry your girlfriend, the process shouldn't be too complicated. However, since you were out of Canada for almost 3 years, you have to make sure you meet your residency obligations, and as a PR you must be living in Canada while you're in the sponsorship process.
 
i lived 2 years and 3 months outside canada...i fulfil residency requirements..i am taking this matter very seriously...Thanks very much ...me and my wife were worried very much about this child that how we will take this baby to Canada. Now should I tell the same entire story to CIC, and I can tell them that baby born prior to marriage. Should I not hide any fact from CIC?

Yes, tell the truth. Sir, I don't know what kind of legal things go on in your home country, but you will not have legal issues in Canada because you had a baby with another person. Not to mention, you were separated from your wife and waiting for divorce. Explain the situation, show proof of your relationship being genuine, etc.
