My girlfriend moved to Canada from Denmark and we are trying to determine the best course of action to ensure she is able to stay in Canada and work as soon as possible.
Timeline of Events
• August 4th 2014- She receives International Experience Canada open work permit that expires August 4th 2015
• September 4th 2014- She arrives in Canada and starts to live with her boyfriend in London, Ontario
• She starts working at a travel agency from October 1st-April 1st for an average of 25-30 hours per week
• She started working part-time at a social purposed start-up in mid September and transitioned to a full-time supervisor April 1st 2015
• August 2nd 2015- Before the IEC program expired she applied for a closed work permit contingent on a positive LMIA from her employer, which allowed her to continue to work
• September 1st 2015- Relocated residence from London to Mississauga, Ontario
• November 26th 2015- received a letter from CIC with a refused work permit (Due to a negative LMIA since the median salary was 15 cents off of the median. This letter stated that her temporary resident status expired November 26th, 2015)
Next Steps
• She now has 90 days to complete a restoration of her status so we will be filling out IMM 5708 to allow her to continue to stay in Canada as a visitor. We will also include in the application that a common-law sponsorship application will be submitted the first week of December 2015.
• We will submit the massive application for common-law sponsorship the first week of December 2015 and will likely not get a decision for nearly two years. We hope to get initial approval on the application in approximately 4 months, which will allow her to work in Canada and have health coverage.
