Hi All,

I am in a dilemma and wanted to seek advice from the experts out here. Trying to evaluate the options I have and make a decision soon. I hope you folks can assist me and guide me to pick the right path.

Below I'll describe my current status and then I would request you all to go over it and provide me some plausible options of out it.

Personal
Nationality: Indian
Married: Yes
Children: No

Work/Life
Currently living & working in: New York City, USA
Domain of work: Finance, Investment Banks
Working as Consultant (Business Analyst) via a very-small-desi-consulting-firm.

US
How many years in USA: 7 years on H1-B Visa
H1-B Visa expires: Sept 2014
Wife's legal status: Just got her H1-B in 2012 and looking for a job. H1-B expires Sept 2015.

GC
GC Status: I-140 cleared in 2010 and waiting forever for the date to be "current".
Priority Date: June 2010 (EB2 processing)

Category: FED-SKW
PR card issued: Jan 2012
PR card expires: Jan 2017

After having gone through my profile, I would like to ask you a few questions.

1. I would not like forego my US status on H1-B and GC processing and start afresh in Canada – What are the options I have to maintain my PR and the GC (both)?

2. If at all, I am only interested to look for jobs in Toronto – Finance. How's the job market there?

3. As you all know – Canada is always in the Plan-B addendum of the Master-Plan, do you think I will get my GC in few years (hopefully by 2014), so that I can completely eliminate the Canadian option and forego the CAD-PR?

4. Do you think struggling here for few more years on H1-B and waiting for the never-ending-wait of CG is better than coming over to Toronto and starting the 3 year clock needed for Citizenship!

5. My small-desi employer has no contacts/connections in Canada so the only option left would be to leave my current job and move to Toronto (if I decide to settle in Canada).

6. I know there are many others in the similar "H1-B => GC => Citz (US)" or "PR => Citz (Cad)" conundrum. What path's have you all chose and why?

7. Would it be possible for my wife (non-technical) to get a job in Toronto?

8. I am assuming that my Salary in Canada + my Wife's salary in Canada = my current US salary?
Really appreciate if someone could help me figure this out!

My concern is if I move to Canada and complete my 2-5 years for PR & Obtain Citizenship... Under current rules etc.

Will I be able to resume GC Process with same Priority Date ( Sept 2012) if I find work in US after entering with one these options ( Which One is valid/recommended) ? :

- TN Visa
- H1B ( New one )
- H1B ( Filing AOS after entering US on visitor/business Visa etc??)


DO the employer need to same or it could be any other with similar skills/experience?
Any other way to get back in GC process?

You questions should be posted in a US immigration forum, as Canadian immigration rules can't tell you if you can stay in Canada while waiting for your US green card approval..

Can you please send me link to that forum ? I was not expecting a forum on US immigration discussions on "canadavisa" site.

This site helped me a lot during my Canada Visa application and I thought there will be many people like me as I found one on this thread.

Eventually one thing is for sure, you cannot have it both, Green card and Canadian PR. If I was you, stay in the US
and be happy with what you've got.

Yes Better to stay in USA.
 
You'll only be disappointed from Canada. If you've already got an open ended way to live in the US, I wouldn't bother.

The thing is, will his H1B ever expire? If he waits in the US and the H1B expires before getting the green card, it's possible to lose both Canadian PR (because of failing the RO) and the US green card... I think that's where the worry is. But if he comes and stays in Canada, will he lose the green card application? This question can only be answered in a US immigration forum, though.
 
My H1B Expires in 2 Years. I have done one stamping in past and shouldn't be an issue if its needed again. But GC seems at least 3-5 years away.

Found from an Attorney that I can claim GC from Canada itself, if Priority date become current and I am working for same employer in Canada ( Which may not happen but checking within org.)

Basically, I'm confused since on Canada side it will be hard time now (moving and settling with new born twins) But on other side it may be sun set in future in USA in case GC process or H1B or my job runs into any issues in next few years.

Just to be frank... I am reluctant in going back to India if given an option for Canada or USA.... Thus super confused !

Your mind is obviously tilted towards US GC.There is no doubt that it is tough starting all over in Canada especially since it is a smaller Economy with lower employment prospect compared with US however,You've got PR and that's 'a bird in hand' which provably is better 100 in the forest.I think the option you should look at is to explore sitting for Finance certifications recognized in Canada since it will enhance your employability in Canada while waiting for the GC and if all is done,you will need to make a choice between continuing perpetually with H1 B and allow your PR to expire or move to Canada and observe the time and secure your place in the western world with the Canadian Citizenship
