Well that's not far away. Was there anything on your application that would have caused a red flag? Age difference, short marriage etc? You will be fine I am sure!

Hi guys,

Firstly apologies, I'm sure that I'm in the wrong place, I've been reading the forums for hours and would love some advice to get started.

My situation: I'm British, in Canada for IEC (last 6 months), have lived with my Canadian girlfriend for 2 years, 6 months (2 years in UK, 6 months in Canada). My IEC runs out in October, and I'd like to stay here in Canada, so want her to sponser me as my common law partner (I think we qualify? we have plenty of proof of living together for this time, shared bills etc).

Frankly, I have a level of stress that is making me feel nauseous right now, and I'm somewhat terrified. Reading the various sites and filling out forms all day I'm no closer to understanding what to do, but I have a creeping feeling I am screwed. Some of you seem to have been waiting forever for this, but I'm clinging to pieces of hope I find lying around like the fact that Family visas for common law partners take 90 days etc...

I guess my question is this: what's my first step, do my girlfriend and I have to register as common law officially. Would it help if we married? (it wouldn't be just to sneak into Canada, we are headed that way but were going to wait a while). If so she has to register as a sponsor - she's a student but has an income, I'm a freelance web developer but my income is pretty good. I understand we have to choose between inland and out land application, why would I choose one over the other? Apparently out land is faster?

If anyone had any advice that could help I'd be so grateful. Sorry again if I'm in the wrong place.

Thanks in advance

Hey Gideonj,

first of all - welcome! you have come to the right place, and you'll find plenty of information here, and lots of people to answer questions. it is a stressful process, and we all go through phases of ups and downs, so that's normal! welcome to the club....

You don't need to register officially as common-law, if you have been living together for a year, and can prove it, then you are already common-law. You don't need to marry either - at least not for the application, as if you qualify already for common-law, it's pretty much the same proof you will need.

As for outland or inland - outland is way faster! if you check on this page, on the top you can see the difference between outland and inland, and what to consider if you want to be sponsored - you can start by reading that. current times are 90 days to get approved as a sponsor, and on top on that, 7 months for London applicants, but it can also be a lot faster. You can do the outland process even if you are living in Canada, no problem. If you already have a visa (from what I understand) you could start the process now, and maybe your visa will run out before you get the PR approved, but if you are from a visa exempt country, then you can wait in Canada on a visitor visa. You wouldn't be able to work in the gap between your IEC and your PR visa, though.

For your girlfriend to sponsor you - there are no income conditions, unless you have children. so the fact that she is a student is fine. The main thing you will have to prove is that you are returning to Canada ( easy for you as you already live there) and you are in a relationship. She also needs to qualify as a sponsor (check the CIC website to see > criminal check, no bankruptcy etc.).

apart from that - start gathering evidences, proofs of relationship, of living together, download all the forms, and start filling them out! it takes a while, it's a stressful process, but you can always come here for advice, and read what other people have done, how they have organised their application etc, and you will be fine!

Good luck!

Hey again Gideonj,

here are the links I was mentioning before:

For a good overview of what to consider before applying, see here :
http://www.canadavisa.com/canada-immigration-discussion-board/spousal-sponsorship-t46995.0.html

for the link to cic website and the forms for outland applications:
http://www.cic.gc.ca/english/information/applications/fc.asp#immigrate

you already found the UK thread, for more specific questions concerning applications going through London, so all good!

Good luck,
Sweden

Sweden, thank you!

After a stressful day - your kind advice goes a long way. It's a big relief to find a crowd going through similar things to me. I'll jump on your advice and be sure to try and take advantage of all the info here. I've got hope :)

I'll dive into the process of getting my girlfriend approved for sponsorship first thing tomorrow!

Hi everyone

I wanted to share with you that i got an update on my status yesterday and my home address is showing up on the status again after a long disappearance. I don't know why they have put it back in there again. Any thought on this would be appreciated.

I've taken my first steps towards application, feel like I am knee deep in forms: but this is something you have all done before me :)

I ask this question here in case there is some rule pertaining to UK nationals specifically, but please let me know if it is better suited to a more general spousal sponsorship thread.

I intend to stay in Canada one way or another if at all possible when my 1 year work visa expires in October. As such I'm starting this process now, but with only 5 and a bit months on the clock, seems like the odds are it will take much longer (more like 10 months) before I am approved if successful. As such I am considering also going to school for a year starting in September, which would position me to apply for a student / study visa.

I may as well learn something while I can work right? :) and it would be good for a year - my question is, is it possible to obtain a other types of visa (i.e. a student one) while an ongoing spousal application for permanent residency is taking place? I've done my best to read the CIC website for answers to this, but can't find anything. Perhaps someone has experience of this rather specific thing?
Thanks!!

Thanks zaig. Just out of curiousity did you redo your medical since your application took a bit longer like mine as per your timeline?
