Are we eligible for adjustment of status or we should do consular processing only?
Some may argue, say I filed AOS when I was physically present in US and then I travel on other non immgrant status H1b/TN. In this case naturally AP will be denied without affecting rest of I485 petition.
But other non immigrant status gives you flexibility to travel, does that give you flexibility to abandon residence in US while AOS is still pending?
Sorry no definite answer, just my two cents, as for me I moved back to US first and only after that filed for AOS.
