I'm not sure how difficult this one is.

Shortly before I turned eighteen I beat up someone at a party who was threatening others, but I wasn't arrested until the day after I turned eighteen. I was charged with aggravated assault, and sentenced in an adult court to 400 hours community service. It was taken in to account that I was a young offender, but was sentenced in an adult court because I was eighteen at the time of arrest.

I understand that had this been pulled off in Canada, I would have been sentenced under the youth justice act, but I received an adult sentence in my country because of my age at arrest that attracts a max sentence of 14 years in Canada, therefore considered serious criminality. Any help would be appreciated.

Thank you.

Re: The YJA and Foreign Adult Sentences

We've seen a small number borderline minor cases here (although I believe the two we've seen involved more minor DUI charges). You should assume CIC will treat the charge as an adult charge (and be happily surprised if they don't). How long ago did you complete the community service? Has it been more than 5 years?
