The Islamabad Immigration Officer doubts the genuineness of marriage

Hi, Please help.

I was married in January 2009 and my spouse is Canadian PR holder. My wife went to Calgary, Canada in March 2009 after marriage. She sponsored me immediately and applied for my immigration. I sent my papers in Sept. 2009 and that was time when official process started. Me and my wife are childhood friends and had lived in same town for all of our life. Her family moved to Canada in 2007. My wife came back to Pakistan in April 2010 believing that my immigration process will be completed soon and we will be travelling together to Canada. Meanwhile my wife got pregnant. The following happened meanwhile and i need your help.

I was asked for an interview in May 2011.
During my interview i told the consul that my wife is pregnant and she has been living with me since April 2010 but now she will not stay further and moving back soon considering her pregnancy. Mediacal reports of her were submitted during interview.

She moved backed to Calgary Early june 2011 as we wanted to have our baby be born in our adopted country and i noted her departure to imigration office.

Now i received a letter from Islamabad immigration office and they apparantely dont seem satisfied with our marriage and want a certain proof of genuineness of marriage and my plans if i am denied PR. I have to resubmitt the application and certain forms.

what to do?
Should i visit a consultant. What course is in the best interets of us?

show proof of communication, when your wife was living with u did u take photos with her and other family members perhaps get some notarised letter from family and friend if any of her canadian relatives have spoken to you get letters from them too show proof of communication after she went back show you guys talking about the baby and how u long to see your child etc...thats all i could think of oh yeah phone calls

You should also be aware that as a PR, your wife MUST be living in Canada in order to sponsor you. She must also continue living in Canada while your application is being processed. It's OK to visit you for a short time (i.e. 2-3 weeks). However she should avoid longer trips out of Canada or CIC may determine that she is no longer living in Canada.

There is something I am not getting! You have been married for 2 years and a half, you are childhood friends, you had lived in the same town all your life, your wife lived with you for more than a year, you just had a child... how can't they believe your marriage is genuine???? What else do they need???

I read many cases on this forum where the couples met online one or two years ago, visited for a few weeks and got their application approved without any problem.

It makes me mad to see the authorities won't allow a child to have both his parents living under the same roof.

Did they tell you why they believe your relationship is not genuine? Am I missing something here?

My heart goes out to you. If I was in your position, yes I would hire someone to handle my case. I wish you the best!!!

Are you sure it was the genuiness of the marriage that was the main issue? Your wife is a Canadian PR, and as such is supposed to stay in Canada while the processing of her spouse's application is going on. Instead, she was living in Pakistan for more than a year during the processing. You are lucky they are asking for more evidence instead of just refusing the application outright.

However, since she was with you for more than a year, provide all the proof of this you can: you should show them evidence you were living together as a married couple: in Canada, this would be things like both names on a lease / mortgage / property deed, both names on the utility bills, joint bank accounts and credit cards, bills for household items in both names, mail addressed to both of you at the same address, each other named as the beneficiary of each other's insurance and wills; affidavits from the landlord stating you are both living in the same place; affidavits and letters from family members and friends stating they know you two are married and believe the marriage is genuine.
Some of this evidence may not be available in Pakistan, or not in your case, so get what you can.

Also outline for the visa officer your plans for your future together as a family, with any proof possible: what you plan to do in Canada, and what you will do if the visa is refused.

Lots of people from CHC-Islamabad have received such objection letters. Follow the thread below for Islamabad applicants and I am sure you will find lots of help there and what their experience is regarding that issue, what to send them as proof, what not to send and all that is available there:

The main reason you got that letter is becuase you are a Pakistani, and they think everyone in that nation is same. That is one of the reason why they have increased the timiline from being 6 months(in 2008/2009) to 23 months(in 2011) thats just one bitter truth. So follow the thread and I know there are alot of applicants in that same situation as you. My wife's case is a simple straight forward case, no travel history, no works history and is been going on since January 2010 and still no VISA so I know exactly how you feel. There are lots of people like you and me travelling in that same boat so come on and jump in we will do our best to help you out!
