How can we get a free lawyer? What can they do? will they deport me or just reject me?
I come from a country where I will be jailed if I return back home because I attempted to get PR to Canadian. This is horrible situation. I am fearing for my life and my wife is panicking. If they threaten to deport me how does this go? My wife is ready to just retreat into the back bush so that we can finally be in peace together and away from this. She has PTST from her past abusive relationship and since hearing this bad letter from this officer she has been panicking since. We contacted some lawyers and they quoted it would be $5000 just to write a response letter....we do not have this kind of money.
Really important to get a *good* lawyer and deal with this issue bc it’s a serious accusation and could lead to negative consequences if not handled properly. They will usually not make such a bold accusation just bc of Facebook name or online rumours.

Have you ordered GCMS notes before or asked the visa officer how she reached this conclusion? Could you write to the marriage registrary in Korea and ask them for a letter stating that your wife has never been legally married there (might be a long shot but worth a try) ?

Please when did you apply and when was your interview? Was your file transferred to a local office first?

My wife wrote to the local city hall where she lived before and asked them for some sort of document to say she is not married and that she is single. I am not sure if they will give such information via e-mail but its worth a try. Our case was transferred to a local immigration officer who has been the same one dealing with our file for about 11 months now. Just before March was our first interview but it was cancelled, and the phone interview was today. During the whole phone conversation the immigration officer never once mentioned marriage before, not even a hint. It was only right after we got off the phone she sent the email letter. It was shocking to my wife. She felt backstabbed. It all makes sense how the officer had been rude and odd towards my wife and I from the very beginning. She mentioned multiple times comments like "Your partner" (Instead of husband/wife) and she mentioned "Is your husband in the same house as you?" "You do live together right?" "Do you live together" "How come you listed your address as ____ in 2016 (way before we are married and before I moved here) . She also hardly looked at our file and kept asking questions that she should have answers to already and she then said "Well I guess I will have to look over the file again". She kept asking over and over again why we do not have kids, even though my wife had said before we will have kids once I have an immigration status and it is safe for us. She obviously does not want to have kids if its a chance I could be deported and jailed or we have no country to live in...

It is just so upsetting for my wife to have the thoughts of her ex boyfriend even mentioned. She does not want to remember him at all. It was a very traumatic time for her. This horrible news made her unable to even continue working this week because she can't focus on anything except for this. She is panicking so much I have never seen her like this. The thought of me getting deported scares her. She knows it would be the end of me.


We do not know how to order the notes. That would be nice to order them.

Very sorry you and your wife are gong through this, the officer should have told you guys her main concern during the interview. I hope you are able to resolve the matter and get your PR. You need strong evidence that your wife is not married because PFL is a very serious letter. You can use these resources to order gcms notes but usually it takes 30 days or more to get the notes so you will probably have to respond to the PFL before you receive them. @helpwhattheheck, imo as other member mentioned, it most likely this old TRV Application your wife's ex abusive boyfriend had filled out.
I suspect it is very highly likely he didn't think twice and could of entered MARRIED
in the application, maybe he considered a 4yr common law as marriage. Since he was highly abusive and controlling he might of considered her HIS WIFE...it is quite possible.
This kind of stuff immigration bites you in the butt. They love to check old Visa applications, old visa denials, etc. Then they cross reference that information in any future apps with IRCC. I really doubt that CSIS Canada dug up some rumors on the internet about your wife lol their job is to check threats to national security.
About Facebook page with last name - also highly doubt it was found because the last
name used was an Alias so any query would not generate hits on any known last names - they dont use facial recognition technology to scan the internet at IRCC, its not a James Bond movie lol.

You waited too long to order GCMS notes. Why? You are supposed to order notes IMMEDIATELY once you know you are going to have an interview - that way you can be prepared to what is the VO doubt about you and offer clarification during the interview.

You NEVER say to a Visa Officer on the phone "Cant talk long but we'll call you back".
If V Officer call YOU, you talk until VO says GOODBYE. CSIS will arrange another date if you explain a VISA OFFICER gave you a call at the SAME TIME.

Yeah I didn't mean to do this because at first I thought she was the CSIS people, I was just walking in the door. I had answered saying "I am here, I am outside for my interview" and she was confused and was like "What are you talking about?! Your interview was canceled!"

and I said "I am here though, you told me to come in, now the security is coming to get me" or something like this, then I told her I do not understand what is going on but I will tell my wife to call, she hung up after that. When my wife spoke to her after she was somewhat calm and just said that CSIS is another department and has nothing to do with her specifically on the case.

I applied for the notes on the file. I am not sure if this woman will wait till I provide evidence my wife is single in Korea. I asked her what information she can provide given her statement that she was never married...

As much as I know, even if you were to order GCMS notes, it is not possible for you to know their sources. Background check, mis-representation are not detailed in such.
gcms notes censors SECURITY check. When CSIS gives a report to IRCC it indicates all the hits it got, if any, on threats to national security.
IRCC is the one who checks for previous Canadian TRV - this information is not censored, any person can access their old TRV application thru ATIP.
So if Visa Officer dug up an old TRV application and found inconsistencies with current application, they will indicate it on gcms notes. This information will be used in case there is an appeal, so the judge can see the nature of the misrep.

It might have been when she traveled to Canada with her abusive Ex, she does not remember what he or her said to the immigration officers. It might be likely though that they might have said they were going to meet her parents and called him "partner" . Also we didn't know that she would want to talk to us today. She actually sent us an email at almost midnight the night before and told us that she will be calling the next day right in the morning. I guess she wanted to pull a fast one and surprise us to see if we actually live together. We feel so disturbed at all of this. I really hope that the office in Korea can give us some paper to say she was single.

Did you apply OUTLAND or INLAND?

Its not what they SAID, its what they filled out their marital status was on the Visa.
If they filled out MARRIED, then she is SCREWED.
But we dont know, that's why you need either Visa Officer tell you the REASON or you read what it says in gcms NOTES.

Oh when they entered Canada it was a tourist visa on demand at the border they never applied for a visa before hand.

Ok, idk what is Visa 'On demand'...but something was said or written.

Do not let them DEPORT you, do not overstay your VISA, otherwise you cannot
apply OUTLAND and your only option is to move to Canadian bush, but that's NO LIFE to be in constant hiding and have no rights forever.

An interview with csis overrides immigration. Not many people ever have contact with CSIS.
