My younger brother just got a visitor's visa.



Few items:

He has a Law Degree and was working in a law firm

1. He wanted to pursue further studies in Canada (Masters's Degree) but due to unforeseen reasons, we knew he wouldn’t get a student visa while here in his home country so he never applied for it.
2. A few weeks ago, via an agent he managed to get a 5-year Visitors visa.

Process:


-He had an appointment with VSF Global they took his biometrics and he paid (but the agent handled everything ) after a few weeks he got an email from VSF that the envelope and decision had to be collected and we confirmed this via VSF tracking online

The agent collected the passport on his behalf and I wish to point out that we’ve only paid him 90% of the agreed fees and my assumption is that he will give us access once we finish the last payment.



The plan is he has to convert his visitor to either work or student visa while in Canada. The aim is to get PR at some point


Questions:

Which is a better and easier conversion option student or work?

1. How much does it cost? via lawyers?
2. Comprehensive list of docs that he should have for either of the two options
3. Time limits?

Any input would be greatly appreciated.

For a work permit he needs to secure a job offer and approved LMIA from an employer in Canada. A lawyer really can't help with this. Your brother needs to find a job on his own. This can be quite challenging to do since most employers are not willing to go through the process. The job your brother finds should be related to his previous education or work experience.

For a study permit, he needs to show a bank balance of $25k minimum and be accepted into a school and program. The program he picks should be related to his previous education and/or studies and show a progression in studies. No lawyer is needed to apply. His application will need to be sent to his home country visa office. The application cannot be processed from within Canada.

He can apply from within Canada but it is still processed from home country/outland. This is not a new policy. He needs to show that the program will give him better and higher pay job opportunities in home country, advance his current education, show ties to return and funds. If he is over 22 then he needs to still show some of his own funds. Pay first year tuition and his bank balance should be a minimum of $10k for living expenses.

Did you even click on the ”where you are applying from”. It then asks for inside or outside Canada. If you click inside Canada, it gives specific instructions on who can apply from Canada. It is not your brother. So he can apply while staying with you but his application is processed from home country. He will have a weaker application if in Canada because it may be more difficult to show ties to return home, career opportunities etc. If he is doing his Masters he has a stronger case.

It is not your brother. So he can apply while staying with you but his application is processed from home country. To qualify for a work permit, he needs a job offer from an employer in Canada and that employer needs to obtain an approved LMIA.

Has he secured a job offer supported by an approved LMIA?

To add to what @scylla has already mentioned his Canadian job should be related to his current employment and education. To get approved for a WP he can’t just apply for any job. The process can take around 6 months if your employer already has LMIA. Has he looked into whether he qualifies for express entry?
